Summary of the facts Itrantais . voir p . 561 The applicant was arrested in February 7968 . During the preliminary investigation h e confessed three murders but did not adniit that he had acted out of sexual motives . In January 1972, the editor of a weekly magazine started a series of articles in which the applicant was described as a "mass-murder" 1"Massenmorder'1, as "one of the greatest sex murderers in German criminal history" 1"einer der grossten Lustmorder der deutschen Kriminalgeschichte'1 and as a"foudold murderer" ("vierfacher Mdrder1 . Five days later the Regional Court of Manheim, at the applicant's request, granted a temporary injunction prohibiting the editor from using the above expressions, prior to the final judgment determining the above charge . In February 1972, the same court rejected an objecrion filed by the editor, on the ground that the expressions used had violated the applicant's "right of personnality" and might influence his trial . In late February 1972, the applicanr was convicted on three charges of murder, two attempts of murder and one of indecent assault on several children, and sentenced to life imprisonment . The Court, however, determined that it had not been proved that the applicant had killed out of sexual motives .
The applicant lodged an appeal on points of law with the Federal Court . In August 1972, the Court of Appeal of Karlsruhe, on an appeal by the editor, set aside the injunction of January 19 72, confirmed in February 1972.
The Court of Appeal noted that the applicant had described himseH in a letter as a "great murder" ; that he had in fact been convicted of a murder committed in 1950 ; and that he had just been convicted on three further charges of murder, although the applicant's appeal on points of law was still pending. Moreover, it was clear that he had killed out of sexual motives . A constitutional appeal of the applicant was rejected in January 1973 by a group of three judges of the Federal Constitutional Court . _ 5q -
In December 1972, in the main proceedings IHauptsacheveAahrenl concerning the publication, the Regional Court again decided in favour of the applicant and stated that it could not agree with the judgment of the Coun of Appeat. The editor lodged an appeal . Incidentally, the Presiding Judge of the Criminal Chamber of the Regional Court refused in January 1973 to permit the applicant to participate in a television programme on delinquency . This prohibition was upheld by the Court of Appeal on the grounds that the proposed appearance of the applicant in the television programme might prejudice the criminal proceedings against him, which were still pending and violate the principle of presumption of innocence . In October 1973, the Court of Appeal set aside the order insofar as it prohibited the editor from using the expressions "mass murderer" and "fourfold murderer" but maintained the prohibition to use the expression "one of the greatest sex murderers in German criminal history". The applicant submitted to the Federal Court a request for free legal aid for lodging an appeal on points of law . The Court, however, rejected the request stating that the appeal would lack sufficient prospects of success .
In December 1973, the Federal Court rejected the applicants appeat, in the criminal proceedings .
The applicant complains before the Commission thet the decisions of the Court of Appeal of August 1972 and of the Federal Constitutional Court of January 1973 violated the presumption of innocence in stating that the editor was right in calling him a mass and sex murderer, while his criminal conviction had not become final.
THE LA W The Commission first considered the applicant's complaint that the decisions of the Court of Appeal of . . . August 1972 and that of the Federal Constitutional Court of . . . January 1973 violate the presumption of innocence laid down in Article 6 (2) of the Convention . Anicle 6 (2) of the Convention secures to everyone charged with a criminal offence the right to be presumed innocent until proved guilty according to law .
When, in the present case, the Court of Appeal at Karlsruhe gave the decision complained of, the applicant had been convicted for murder and sentenced to life imprisonment, but his appeal was still pending before the Federal Court . The Commission observes that the decisions of the Court of Appeal and of the Federal Constitutional Court were given in the injunction proceedings instituted by the applicant in February 1972 against the publishing house . These proceedings thus concerned a dispute of a civil nature between two private parties . However, it clearly results from the wording of Article 6 (2) that this provision is not intended to apply to such proceedings and is therefore not directly applicable to the present case . The Commission however considered, ex officio, that the applicant's complaint might give rise to a question under Article 6 (1) of the Convention in that the findings of the courts complained of in the injunction proceedings could have prejudiced the applicant's case pending before the Supreme Court in the criminal proceedings . However, the Supreme Court upheld the decision of the Regional Court of . . . February 1972 that it had not been proved that the applicant had acted out of sexual motives . In the Commission's opinion it follows that the findings of the courts complained of in the injunction proceedings do not appear to have influenced the final findings of the Supreme Court in the criminal proceedings in this respect .

An examination of the case as it has been submitted by the applicant does not, therefore, disclose any appearance of a violation of the rights and lreedoms set forth in the Convention and in particular in Article 6 111 .
It follows that the application is manifestly ill-founded within the meaning of Article 27 121 of the Convention . For these reasons, the Commissio n
DECLARES THIS APPLICATION INADMISSIBL E Résumé des faits Arrété en tévrier 1988, le requérant avoua, au cours d'une enquére préliminaire, avoir commis trois meurtres mais nia le mobile sexuel . En janvier 1972, l'éditeur d'un hebdomadaire illustré commença la publication d'une série d'articles dans lesquels le requérant était qualitié de « meurtrier en masse »(« Massenm6rder u ) , d'rr un des plus grands meurtriers sexuels de l'histoire criminelle allemande n Irr einer der grtissten Lustmbrder der deutschen Kriminalgeschichte ul et «meurtrier par quatre fois » Irr vierfacher Môrder ul . Sur demande du requérant, le tribunal régional de Manheim rendit cinq jours plus tard une ordonnance provisoire interdisant à l'éditeur l'usage de ces qualificatifs tant que le requérant n'aurait pas été jugé. En février 1972, le même tribunal rejeta une opposition formée par l'éditeur au motif que ces qualificatifs portaient atteinte au « droit à la personnalité » du requérant et pourraient influencer le procès . Le tribunal se référait en principe de la présomption d'innocence, vrsé à l'article 6, paragraphe 7, de la Convention européenne des Droits de l'Homme . A la fin de février 1972, le requérant fut condamné a la réclusion à vie pour meurtre dans trois cas, tentative de meurtre dans deux cas et attentat è la pudeur sur plusieurs enfanrs . Le tribunal constatait toutefois que le mobile sexuel n'était pas établi . Le requérant s'est pourvu en cassation auprès de la Cour fédérale de Justice . Sur recours de l'éditeur, la cour d'appel de Karlsruhe annula en août 1972 l'ordonnance provisoire de janvier 1972, confirmée en février 1972. La cour d'appel retenait que, dans une lettre, le requérant s'était lui-méme qualifié de rr grand meurtrier u, qu'il avait déjà été condamné pour meurtre en 1950, qu'il venait d'érre à nouveau condamné pour meurtre, encore que son pourvoi en cassation fOt encore pendant, et qu'il était évident qu'il avait tué sous l'empire d'un désir sexuel . Un recours constitutionnel du requérant fut rejeté par un comité de trois juges de la Cour constitutionnelle fédérale en janvier 1973 . Dans la procédure en validation de l'ordonnance provisoire (HauptsacheVerfahren), le tribunal régional, en décembre 1972, donna de nouveau raison au requérant et déclara qu'il ne pouvait se ranger à l'avis de la cour d'appel . L'éditeur interjeta appel de ce jugement .
Par ailleurs, le président de la chambre criminelle du tribunal régional faisait interdiction, au requérant, en janvier 1973, de participer à une émission de télévision consarrée à la délinquance . Cette interdiction était confirmée en appel au motif que la participation du requérant à cette émission pouvait irnfluencer la procédure pénale toujours pendante contre lui (devant la Cour fédéralel et porter atteinte au principe de la présomption d'innocence . En octobre 1973, la cour d'appel levait l'interdiction faite à l'éditeur d'utiliser les expressions « meurtrier en masse u et « meurtrier par quatre fois », mais maintenait l'interdiction d'utiliser l'expression « un des plus grands meurtriers sexuels de l'histoire criminelle allemande » . La Cour fédérale de justice refusa au requérant l'octroi de 1 âssistance judiciaire pour se pourvoir en cassation contre ce jugement, un tel pourvoi paraissant voué à l'échec .
En décembre 1973, la même Cour fédérale rejetait le pourvoi en cassation introduit par le requérant contre se condamnation pénale .

Devant la Commission, le requérant se plaint que les décisions rendues en aoJt 1972 par la cour d'appel de Karlsruhe et en janvier 1973 par la Cour constitutionnelle /édéra/e ont violé le principe de la présomption d'innocence en donnant raison é/'étideur qui entendàit /e qualifier de meurtrier en masse et de meurtier sexuel, alors que sa condamnation n'était pas encore coulée en force de chose jugAe .
EN DROI T La Commission a examiné tout d'abord le grief du requérant selon lequel la décision rendue par la cour d'appel le . . . août 1972 et la décision rendue par la Cour constitutionnelle fédérale le . . . janvier 1973 violeraient la régle de la présomption d'innocence consacrée é l'article 6, paragraphe 2, de la Convention . L'article 6 . paragraphe 2, stipule que toute personne accusée d'une infraction est présumée innocente jusqu'à ce que sa culpabilité ait été légalement établie . En l'espèce, lorsque, la cour d'appel de Karlsruhe rendit la décision incriminée, le requéram avait été condamné pour meurtre à la réclusion à vie, mais son pourvoi demeurait pendant devant la Cour fédérale . La Commission observe que les décisions de la cour d'appel et de la Cour constitutionnelle fédérale ont été rendues dans la procédure d'ordonnance provisoire instituée par le requérant en février 1972 contre l'éditeur . Cette procédure avait trait à un litige de caractére civil entre deux personnes privées . Or il résulte clairement du libellé de l'article 6 . paragraphe 2, que celui-ci ne vise pas des procédures de ce genre et n'est donc pas directement applicable dans le cas d'espéce . La Commission a en outre examiné d'office si la requéte ne posait pas un problème sous l'angle de l'article 6, paragraphe 1, de la Convention en ce que les décisions judiciaires incriminées, rendues dans la procédure d'ordonnance provisoire, auraient pu porter préjudice à la cause du requérant dans l'affaire pénale pendame devant la Cour lédérale . La Cour fédérale a toutefois confirmé le jugemeni rendu par le tribunal régional le . . . février 1972 (au pénal), qui constatait que le mobile sexuel n'avait pas été établi . La Commission en déduit que les décisions judiciaires incriminées ne paraissent pas avoir influencé à cet égard, la Cour fédérale dans sa décision finale sur'l'affaire pénale . L'examen de la requête, telle qu'elle a été présentée par le requérant, ne révéle don c aucune apparence de violation des droits et libenés garantis par la Convention et notamment par son article 6, paragraphe 1 .
Il en résulte que la requéte est manifestement mal fondée, au sens de l'article 27, paragraphe 2, de la Convention . Par ces motifs, la Commission DECLARE LA REOUETEIRRECEVABLE .
