THE FACTS
(frençais : voir p. 74)
The facts presented by the parties and apparently not in dispute between them may be summarised as follows :
The applicant is a German citizen, born in 1900 and at present residing in Hindelang (Federal Republic of Germanyl . She is represented by Mr Engelhardt, a barrister practising in Nuremberg . Her application concerns the detention of her husband, Rudolf Hess, in the Allied Military Prison in Berlin-Spandau . The applicant's husband was born in 1894 in Alexandria ( Egypt) . In 1925 he becam e Hitler's privatesecretary and "deputy of the Führer" of the Nazi party in 1933 . In December of the same year he was made Minister without portfolio . On 10 May 1941 he made a solo flight from Augsburg to the United Kingdom and landed by parachute near Glasgow in Scotland bringing peace proposals . These proposals were rejected and he was made a prisoner . In the autumn of 1945 he was brought to Nuremberg and prosecuted before the International Military Tribunal . He was acquitted of the charges of war crimes and crimes against humanity but found guilty of conspiracy to wage aggressive war and crimes against peace. By judgment of 30 September and 11 October 1946 he cas condemned to life imprisonment . Together with six other principal defendants who had been given prison sentences by the International Military Tribunal he was transferred on 18 July 1947 to the Allied Military Prison in Berlin-Spandau . Spandau Prison is located in the British sector of Berlin and is guarded in monthly turns by the United States of America, France, the United Kingdom and the Union of Soviet Socialist Republics . Since the release of the last of the other Nazi prisoners from Spandau on 1 October 1966 Rudolf Hess has been in solitary confinement in a building capable of holding 600 prisoners . Since this time the applicant and her son have increased their efforts to obtain his release on humanitarian grounds . They have received considerable support and encouragement from most Governments in Western Europe and the United States Government expressing the opinion tha t

Rudolf Hess should be released . The applicant submits that the Soviet Government insist on their veto against the Western efforts to release RudoM Hess . Complaint s The applicant alleges a violation of Arts . 3 and 8 of the Convention. She complains that her right to family life is being violated by the long and inhuman detention of her husband . She argues that although her husband has not been condemned to solita ry confinement he remained the only prisoner in Spandau Prison since 1968 . She further complains that Rudolf Hess has not been permi tted to see the contents of his files concerning the proceedings before the International Milita ry Tribunal or publications relating to his case . He has never been given any submissions which his lawyer made to the Control Council, the European Commission of Human Rights and the United Nations . The applicant is of the opinion that the United Kingdom is responsible for the detention of her husband and therefore also for a continued violation of the Convention on Human Rights . She argues that the Convention on Human Rights also applies to the interpretation of the Agreement of 8 August 1945 concluded in London between the Governments of the United Kingdom, the United States of America, France and the Union of Soviet Socialist Republics . She states that her husband has served long enough and claims that the Commission should press the United Kingdom to step up its efforts to secure renegotiation ~f the Four Power Agreement over Berlin in order to obtain the release of Rudolf Hess . If this is not possible within three months then the United Kingdom should release him when it is next responsible for his custody .
THE LAW IExtract ) The Commission is of the opinion that in the present case the point at issue is whether or not the subject matter of the complaint is a matter within the jurisdiction of the United Kingdom within the meaning of Art . 1 of the Convention . Art . 1 provides that : "The High Contracting Parties shall secure to everyone within their jurisdiction the rights and freedoms defined in Section I of this Convention" : The Commission first observes that in the present case the exercise of authority by the respondent Government takes place not in the territory of the United Kingdom but outside its territory, in Berlin . As the Commission has already decided, a State is under certain circumstances responsible under the Convention for the actions of its authorities outside its territory, (decision of 25 September 1965 on the admissibility of application No . 1611/62, X. v/the Federal Republic of Germany, Yearbook 8, page 158) . The Commission is of thé opinion that there is in principle, from a legal poinj of view, no reason why acts of the British authorities in Berlin should not entail the liability of the United Kingdom under the Convention . The question therefore arises whether the Commission, in the particular circumstances of this case, is competent to receive an application egainet the United Kingdom in respect of the continued imprisonment of Rudolf Hess . For the purposes of determining the obligations of the United Kingdom under Art . 1 of the Convention, the Commission recalls that Spandau Allied Prison wae established by the Allied Kommandatura Berlin in compliance with a directive of the Control Council . This followed from the assumption in 1945 of supreme authority by the Four Powers with respect to Gennany . The supreme authority over the prison was vested in the Allied Kommandatura . The executive authoriry consists of four governors acting by unanimous decisions . Each of the governors is the delegate and the representative of one of the Four Powers . The rights and obligations arising out of the agreements between the Four Powers concerning Spandau Prison continued to be in force after the withdrawal of the Soviet Union from the Kommandatura . This fact is not disputed by any of the parties . In regard to the administration of the prison, the Commission notes that changes therein can only be made by the unanimous decision of the representatives of the Four Powers in Germany or by the unanimous decision of the Four Governors . Administration and supervision is at all times quadripartite, including the day to day "civil administration "

of the prison and the responsibility for providing the milita ry guard . The instructions of the Governors a re carried out by warders appointed by the Four Powers and other prison staff appointed by the Four Governors . The quedripa rtite administration and supervision does not va ry with the rotation of the milita ry guard and the chainnanship among the Four Governors . The Commission concludes that the responsibility for the prison at Spandau, and for the continued imprisonment of Rudolf Hess, is exercised on a Four Power basis and that the United Kingdom acts only as a pa rt ner in the joint responsibility which it sha re s with the three other Powe rs . The Commission is of the opinion that the joint authority cannot be divided into four separate jurisdictions and that therefore the United Kingdom's pa rticipation in the exercise of the joint authority and consequently in the administration and supervision of Spandau Prison is not a matter "within the jurisdiction" of the United Kingdom, within the meaning of A rt . 1 of the Convention . The conclusion by the respondent Government of an agreement concerning Spandau prison of the kind in question in this case could raise an issue under the Convention if it were entered into when the Convention was already in force for the respondent Government . The agreement concerning the prison, however, came into force in 1945 . Moreover, a unilateral withdrawal from such an agreement is not valid under international law . It follows that the application is incompatible ratione pe rsonae within the meaning of Art . 27 ( 2) of the Convention . For these reasons, the Commissio n DECLARES THIS APPLICATION INADMISSIBL E
I TRADUCTIO M EN FAI T Les faits exposés par les parties et ne faisant apparemment l'objet d'aucune contestation, peuvent se résumer comme suit : La requérante, ressortissente allemande, est née en 1900 et réside actuellement à Hindelang (République Fédérale d'Allemagne) . Elle est représentée par Me Engelhardt, avocat au Barreau de Nuremberg . La requête a trait à la detention de son mari, AudoH Hess, à la prison militaire alliée de Berlin-Spandau . Le mari de la requérante est né en 1894 à Alexandrie (Egypte) . En 1925, il assume les fonctions de Secrétaire particulier de Hitler ; en 1933, il est nommé « Suppléant du Führer » du parti nazi . En décembre de la même année, il est nommé ministre sans portefeuille . Le 10 mai 1941, il se rend seul en avion d'Augsbourg au Royaume-Uni où, porteur de propositions de paix, il saute en parachute près de Glasgow . Ces propositions sont rejetées et il est fait prisonnier . A l'automne de 1945, il est transféré à Nuremberg et traduh devant le tribunal militaire international . Il est acquitté des chefs de crimes de guerre et de crimes contre l'humanité, mais reconnu cbupable de conspiration en vue de déclencher une guerre d'agression et de crimes contre la paix . Par jugement du 30 septembre et du 1•' octobre 1948, il est condamné à l'emprisonnement à vie . Avec six autres accusés, condamnés à des peines d'emprisonnement par le tribunal militaire international, il est transféré le 18 juillet 1947 à la prison militaire alliée de Berlin-Spandau . Celle-ci, qui est située dans le secteur britannique de Berlin, est gardée à tour de rôle, pendant un mois à la fois, par les Etats-Unis d'Amérique, la France, le Royaume-Uni et l'Union des Républiques socialistes soviétiques . Le dernier des autres dAtenus nazis ayant été libéré de la prison de Spandau le 1•' octobre 1966, Rudolf Hess se trouve détenu seul dans un bâtiment pouvant recevoir 600 personnes . Depuis cette époque, la requérante et son fils ont redoublé d'efforts pour obtenir sa mise en liberté pour raisons humanitaires . La plupart des gouvernements d'Europe occidentale et le Gouvernement des Etats-Unis oM vivement appuyé et encouragé ces efforts, exprimant l'opinion que Rudolf Hess devrai t

être libéré . La requérante fait valoir que le Gouvernement soviétique continue à opposer son veto aux efforts occidentaux visant à libérer Rudolf Hess . Les griefs de la requérante peuvent se résumer comme suit : La requérante allègue une violation des articles 3 et 8 de la Convention . Elle affirme que son droit au respect de sa vie famitiale se trouve violé du fait de la détention prolongée et inhumaine de son mari . Alors que celui-ci n'a pas été condamné à une réclusion avec isolement, il est, fait-elle savoir, la seule personne détenue à la prison de Spandau depuis 1968 . Elle se plaint en outre que Rudolf Hess n'ait pas été autorisé à prendre connaissance du contenu des dossiers relatifs à la procédure engagée contre lui devant le tribunal militaire international, ni de publications se rapportant à son cas . Il n'a jamais été informé des arguments que son avocat a fait valoir devant le Conseil de contr0le, la Commission des Droits de l'Homme et les Nations Unies . La requérante estime que le Royaume-Uni est responsable de la détention de son mari et, partant, d'une violation continue de la Convention des Droits de l'Homme . Elle soutient que la Convention des Droits de l'Homme s'applique aussi à l'interprétation de l'accord conclu le 8 ao0t 1945, à Londres, entre les Gouvernements du Royaume-Uni, des EtatsUnis d'Amérique, de la France et de l'Union des Républiques socialistes soviétiques . Elle déclare que la détention de son maria assez duré et demande à la Commission d'insister auprès des autorités du Royaume-Uni pour qu'elles intensifient leurs efforts en vue d'une renégociation de l'accord des quatre puissances sur Berlin, de façon à obtenir la libération de RudolF Hess . Si cela n'est pas possibte dans un délai de trois mois ; les autorités du Royaume-Uni devraient libérer le détenu à leur prochain tour de garde .
EN DROIT (Extrait ) La Commission estime que la question à trancher en l'occurrence est celle de savoir si le contenu de la plainte reléve de la juridiction du Royaume-Uni, au sens de l'article 1•' de la Convention, qui est libellé comme suit : « Les Hautes Parties contractantes reconnaissent à toute personne relevant de leur juridiction les droits et libertés définis au Titre I de la présente Convention n . La Commission fait observer d'abord que le Gouvernement défendeur exerce en l'occurrence ses pouvoirs non sur le territoire du Royaume-Uni, mais à l'extérieur de ce territoire, c'est-a-dire à Berlin . Elle a déjé eu l'occesion d'admettre que, dans certaines circonstances, un Etat est responsable, aux termes de la Convention, des actes accomplis par ses autorités en dehors du territoire national (décision du 25 septembre 1965 sur la recevabilité de la requête N° 1611/62, X . contre la République Fédérale d'Allemagne, Annuaire S. page M . La Commission estime que, d'un point de yue juridique, on ne voit pas, en principe, pourquoi des actes accomplis par des autorités britanniques à Berlin n'engageraient pas la responsabilité du Royaume-Uni dans le cadre de la Convention . La question se pose donc de savoir si la Commission, compte tenu des circonstances particulières de la présente affaire, peut être saisie d'une requête contre le Royaume-Uni en cequi concerne le maintien en détention de Rudolf Hess .
Afin de déterminer les obligations du Royaume-Uni dans le cadre de l'article 1•' de la Convention, la Commission rappelle que la prison alliée de Spandau a été créée par la Kommandatura alliée de Berlin en application d'une directive du Conseil de contrôle . C'était là une conséquence du fait que les Quatre puissances avaient assumé en 1945 le contrôle supréme en Allemagna . C'est la Kommandatura alliée qui avait été investie de l'autorité suprême en ce qui concerne cette prison . L'organe exécut'd est composé de quatre codirecteurs dont les décisions sont prises à l'unanimité . Chacun des codirecteurs est le délégué et le représentant de l'une des Quatre puissances . Les droits et obligations découlant des accords conclus entre les Quatre puissances quant à la prison de Spandau sont demeurés en vigueur après que l'Union soviétique se fut retirée de la Kommandatura . Ce fait n'est contesté par aucune des parties . La Commission note que des modifications ne peuvent être apportées à l'administration de la prison que par décision unanime des représentants des Quatre puissances en Allemagne ou par décision unanime des quatre codirecteurs . conservent à tout moment un caractére quadripartite, notamment en ce qui concerne l'a administration civile » quotidienne de la prison et la responsabilité de fournir la garde militaire . Les instructions des codirecteurs sont exécutées par des surveillants, nommés par les Quatre puissances et par d'autres membres du personnel pénitentiaire nommés par les quatre codirecteurs . L'administration et le contrôle quadripartites ne varient pas en fonction des tours de garde militaire et de présidence parmi les quatre codirecteurs . La Commission en conclut que la responsabilité de ia prison de Spandau et du maintien en détention de Rudolf Hess incombe conjointement aux Quatre puissances et que le Royaume-Uni n'agit qu'en tant que partenaire, partageant la responsabilité avec les trois autres puissances .
La Commission estime que l'autorité commune ne peut étre divisée en quatre juridictions séparées et que, partant, la participation du Royaume-Uni au contrôle commun et, par conséquent, à l'administration et à la surveillance de la prison de Spandau, n'est pas une question « relevant de la juridiction » du Royaume-Uni, au sens de l'article 1•' de la Convention . Le fait que le Gouvernement mis en cause ait conclu, à propos de la prison de Spandau, un accord comme celui dont il est question en l'occurrence pourrait impliquer éventuellement une violation de la Convention si celle-ci avait été déjà en vigueur lors de la conclusion de cet accord . Or l'accord relatif à la prison est entré en vigueur en 1945 . Par ailleurs, le retrait unilatéral d'un tel accord n'est pas valide en droit international .
Il s'ensuit que la requéte est incompatible ratione personae avec les dispositions de la Convention au sens de l'article 27, 4 2, de la Convention . Par ces motifs, la Commissio n DECLARE LA REQUETEIRRECEVABLE .
