Article 6, paragraphe 1, de la Convention : La Commission n é pas pour t8che de dire si les tribunaux nationaux ont correctement apprécié les preuves mais d'examiner si les moyens de preuve fournis pour et contre l'accusé ont été présentés de maniére à garantir un procés équitable et de s'assurer que le procés, dans son ensemble, a été conduit de maniére à obtenir ce méme résultat .
Summary of the relevant facts ( français : voir p. 78 ) Applicant sentenced to 15 years' imprisonment for offences of buggery and indecent assault of small boys . His conviction was later quashed on the ground that the evidence of the boys had not been duly corroborated . The prosecution appealed to the House of Lords on a point of law relating to corroboration . The House of Lords allowed the appeal referring to the Scottish law practice in this field . The case was referred back to the Court of Appeal who upheld the conviction but reduced the sentence to seven years' imprisonment that the .Theaplicntoms House of Lords' decision effectively change d the law . This was improper as a change of law should have gone through Parliament and unfair as he was unable to present his views himseK to the law lords . THE LAW (Extract) [Finally,7 the applicant complains of the House of Lords' proceedings on appeal . In particular he claims that the House of Lords changed the law to deal with his case . The Commission notes that the applicant's complaint concerns the English procedural laws of evidence . It has therefore examined this complaint, ex officio, in the light of Art . 6 of the Convention . However, the Commission is not called upon to

decide whether or not the domestic courts have correctly assessed the evidence before them, but only "whether evidence for and against the accused has been presented in such a manner, and the proceedings in general have been conducted in such a way that he has had a fair trial" Isee Repo rt of the Commission in the Nielsen case, para . 52, Yearbook 4, p . 568) . The House of Lords was therefore free to assess the value of whatever evidence was put before it . Furthermore, the Commission finds no evidence whatsoever to indicate that the applicant's case was not properly presented or that the proceedings were improperly conducted by the law lords . In pa rt icular, concerning the applicant's non-attendance at the hearing, the Commission finds that the complaint of unfairness is wholly unsubstantiated as the applicant's rights of defence were duly obse rved by the proper presentation of his case by his legal representatives. In the Commission's opinion, therefore, this complaint does not disclose any appearance of a violation of any of the rights and freedoms set out in the Convention and, in pa rt icular, in Art . 6 . The Commission concludes, therefore, that these complaints about the House of Lords hearing are (equally] manifestly ill,-founded within the meaning of Art . 27 121 of the Convention . Résumé des taits pertinents Condamné é 15 ans de réclusion pour attentat d la pudeur des enfants voit sa condamnation annulée en appel au motif que le témoignage porté par les jeunes garçons victimes n'avait pas été corroboré . Pourvoi du ministére public auprés de la Chambre des Lords sur un point de droit concernant la confirmation des témoignages. La Chambre des Lords, se fondant, sur ce point, sur la pratique juridique écossaise, admet le pourvoi. La cause ayant été renvoyée en appel, la condamnation est confirmée, la durée de la peine étant toutefois réduite A 7 ans . Le requérant se plaint que la décision de la Chambre des Lords implique une modification du droit qui aurait dû être approuvée par le Padement . Il se plaint aussi de n'avoir pu comparaître en personne devant les Lords . (TRADUCTION) EN DROIT ( Extrait ) (Enfin,j le requérant se plaint de la procédure appliquée par la Chambre des Lords lors de l'examen du pourvoi et, en particulier, que celle-ci a modifié le droit pour se prononcer sur son cas . La Commission constate que le grief du requérant concerne le droit anglais de procédure en matiére d'administration des preuves ("laws of evidencé') . Elle l'examinera donc d'office A la lumière de l'article 6 de la Convention . Toutefois, la Commission n'a pas pour t9che de dire si les tribunaux nationaux ont correctement apprécié les preuves qui leur ont été soumises, mais d'examiner .si les moyens de preuve produits pour et contre l'accusé ont été présentés de maniére é garantir un procés équitable et de s'assurer que le procès, dahs son ensemble, a été conduit de maniére à obtenir ce même résultét . •(voir Rapport de la Commission sur l'affaire Nielsen, par . 52, Ann . 4, p . 569) . La Chambre des Lords avait donc toute libe rté d'apprécier la valeur de tout moyen de preuve produit devant elle . Au surplus, la Commission n'entrevoit aucun indice que la cause du requérant n'aurait pas été convenablement présentée, ni que les Lords n'auraient pas dirigé correctement le déroulement de la procédure . qui concerne plus spécialement la non-comparution du requérant à l'audience, la Commission consate que les allégations du requérant sont dépourvues de toute substance car les droits de la défense ont été dOment respectés grace à une présentation adéquate de l'affaire par les avocats du requérant . La Commission estime donc que l'examen de ce grief ne révéle aucune apparence de violation des droits et liberté garantis par la Convention, notamment par son article 6 . Elle en conclut que le grief po rtant sur la procédure suivie devant la Chambre des Lords est C, lui aussi,J manifestement mal fondé, au sens de l'article 27, par . 2, de la ' Convention .
