Résumé des faits
Requérant, avocat allemand, en détention préventive 9 la prison de W . En novembre 1973 te tribunal cantonal de F . a ordonné la saisie d'un « projet de roman » du requérant, mettant en scéne divers personnages du monde judiciaire . Cette saisie, décidée dans le cadre de l'instruction, devait permettre au psychiatre de faire un rapport sur la responsabitité pénate du requérant . Le recours formé contre cette décision fut rejeté en mars 1974 par le tribunal régional de N . Le recours constitutionnel fut rejeté par une chambre de trois juges de la Cour Constitutionnelle Fédérale en juillet 1974 .

que ce manuscrit, saisi au motif qu'il devait servir à l'enquPte pénale ouverte contre le requérant, lui a été restitué aprés avoir été photocopié . Le requérant a invoqué à ce sujet l'article 9 de la Convention, qui garantit la liberté de pensée, de conscience et de religion . La Commission ne discerne, dans les faits exposés par le requérant, aucune apparence de violation de ce droit . La Commission a également envisagé le grief sous l'angle de l'article 10 de la Convention, invoqué par le requérant . Cette disposition reconnait à toute personne le droit à la liberté d'expression, qui comprend notamment la a liberté de communiquer des informations ou des idées, sans qu'il puisse y avoir ingérence d'autorités publiques » . En l'espéce, la Commission constate que le manuscrit a été saisi temporairement puis restitué au requérant . Il n'apparait pas, par ailleurs, que des poursuites aient été engagées contre celui-ci relativement à son a projet de roman n ou qu'il ait été victime de quelque interdiction de le publier . Dans ces conditions la Commission estime qu'un examen du dossier ne permet de déceler aucune apparence de violation de cette disposition . La Commission a ensuite envisagé le grief sous l'angle de l'article 8 de la Convention qui garantit notamment le droit au respect de la vie privée . Elle considére que la confiscation, mime temporaire, de papiers personnels porte atteinte à ce droit .
Aux termes du paragraphe 2 de l'article 8, l'ingérence d'une autorité publique dans l'exercice de ce droit est cependant permise lorsqu'elle est a prévue par la loi et nécessaire . . . à la prévention des infractions pénales » . En l'espéce, le tribunal a ordonné la saisie conformément aux articles 94 et suivants du code allemand de procédure pénale (StPO) . Cette juridiction considérait en effet qu'une photocopie du document était utile à l'instruction complète de l'affaire en ce sens que ce document devait aider l'expert psychiatrique à déterminer le degré de responsabilité pénale du requérant . Cette mesure de saisie fait ainsi partie de l'application du droit pénal et reléve de la prévention des infractions au sens du paragraphe 2 de l'article 8 . Elle constitue dés lors une ingérence justifiée d'une autorité publique dans l'exercice du droit à la vie privée .
Le requérant prétend cependant que la saisie n'a pas été effectuée en fait pour les besoins de l'expertise psychiatrique, mais parce que le procureur se serait senti directement visé par le roman, dont le personnage central serait une caricature de sa personne et de sa fonction . Il allégue donc un détournement de pouvoir . La Commission a examiné cette allégation sous l'angle de l'article 8 combiné avec l'article 18 de la Convention ainsi libellé : rt Les restrictions qui, au terme de la présente Convention, sont apportées auxdits droits et libertés ne peuvent être appliquées que dans le but pour lequel elles ont été prévues . n Elle estime que l'assertion du requérant ne repose sur aucun commencement de preuce . En particulier, celui-ci n'a fait l'objet d'aucune poursuite en diffamation et a pu rentrer en possession de son manuscrit . Un examen du grief tel qu'il a été soumis, y compris un examen d'office, ne permet donc pas à la Commission de discerner l'apparence d'une violation des articles 9 et 10 de la Convention, ni de l'article 8, tant pris isolément que combiné avec l'article 18 .

II s'ensuit que la requête est manifestement mal fondée au sens de l'article 27, 4 2, de la Convention . Par ces motifs, la Commis .sio n DÉCLARE LA REQUÉTEIRRECEVABLE . Summary of the facts The applicant, a German solicitor, was detained on remand in W . Prison . In November 1973, the district court of F . ordered the seizure of an applicant's ; "draft nove/" the action thereof involving various characters from the Judiciary . The seizure took place within the framework of the criminal investigation laid against the applicant. It was designed to enable a psychiater report on the applicant's criminal responsibility .
Appeal against that order was rejected in March 1974 by the N. Regional Court. The applicant then lodged a constitutional appeal with the Federal Constitutional Court which was rejected by a three judges' chamber in July 1974 .
I TRANSLATION I THE LAW The applicant is the author of a "draft novel" which, he complains, was seized in the course of his detention . It is clear that the said manuscript was seized for the declared purpose of a criminal enquiry laid against the applicant, photocopied and given back to the applicant afterwards . He invokes Article 9 of the Convention which protects the right to freedom of thought, conscience and religion . However, the Commission fails to see, in the facts as submitted by the applicant, any appearance of a violation of that right . The Commission then looked at the complaint under Art . 10 of the Convention, which had also been raised by the applicant . This provision recognises for everybody the right to freedom of expression which includes in particular, "the freedom to impart information or ideas without interference by public authority" . In the present case the Commission note that the manuscript was seized for a short period and quickly returned . On the other hand, the applicant has apparently neither been prosecuted in relation to his draft novel nor in any way been prevented from publishing it . Under these conditions, an examination ot the file by the Commission does not disclose any appearance of a violation of this provision . The Commission next considered the complaint under Article 8 of the Convention which especially guarantees the right to respect for private life . It is of the opinion that the seizure of a private document, albeit temporary, interferes with that right . Under paragraph 2 of Article 8, however, interference by a public authority with the exercise of the said right is permissible where it is "in accordance with the law and necessary . . . for the prevention of crime" . In the present case, the seizure was ordered by the court in accordance with Section 94 and following of the German Code of criminal procedure IStPOI . A photocopy of that document was held by the Court to be necessary for a full investigation of the case and, in particular, for the assessment by a psychiatric expert, of the applicant's criminal responsibility .

Such a seizure is a part of the enforcement of criminal law and falls under the prevention of crime within the meaning of paragraph 2 of Art . B . It constitutes therefore a justified interference by public authority with the exercise of the right to private life . The applicant claims however, that the seizure was not for the purpose of an expert psychiatric opinion but because the Prosecutor felt the book was directed against him as the central figure in the novel was a caricature of him and his office . He alleges in fact an abuse of power (dAtournement de pouvoir) . The Commission considered this allegation under Article 8 of the Convention in conjunction with Article 18 which reads :
"The restrictions permitted under this Convention to the said rights and freedoms shall not be applied for any purpose other than those for which they have been prescribed . " - However it finds that the allegation is not supported by any evidence . The Commission notes in panicular that the applicant was not prosecuted for defamation and was given his manuscript back . An examination by the Commission of this complaint as it has been submitted, including an examination made ex officio, does not therefore disclose any appearance of a violation of Articles 9 and 10 of the Convention or Article 8, taken either separately or in conjunction with Article 18 . It follows that the application is manifestly ill-founded within the meaning of Article 27 121 of the Convention . For these reasons, the Commissio n DECLARE THE APPLICATION INADMISSIBLE .
