Résumé des faits pertinents

Le requérant, de nationalité allemande, avait obtenu un permis de séjour et de travail en Suisse en 1967 . ll a épousé une ressortissente suisse en 1985. Il a perdu son emploi en 7988 et, en 1970, les autorités d'Argovie ont pris un arrêté d'expulsion à son égard. Cette mesure a été suspendue jusqu'en automne 1971, époque à laquelle le requérant a été effectivement contraint de quitter la Suisse et s'est trouvé séparé de son épouse . Le requérant fit alors de bréves visites à son épouse et, au cours de l'une d'entre elles, il fut arrété puis condamné par le tribunal de Zofingen A une peine d ârrét pour rupture de ban. Aprés échec de son appel, le requérant a adressé un pourvoi en nullité et un recours de droit public au Tribunal fédéral . L'un et l'autre ont été rejetés .
EN DROIT (Extrait) Le requérant se plaint essentiellement du refus des autorités suisses de lui permettre de rendre visite à son é pouse résidant en Suisse . Il allbgue à cet égard la violation de l'a rt icle 8 de la Convention . L'ingérence exercée dans son droft au respect de sa vie familiale ne pouvait, dans son cas trouver sa justification au paragraphe 2 de l'a rticle 8 . II y aurait, en outre, violation de l'article 12 de la Convention en ce que la législation suisse n'a pas é gard à la séparation des époux comme conséquence d'une mesure d'exDulsion . - 124-
Enfin, il allégue la violation des articles 5 et 6 quant é son arrestation, sa détention et sa condamnation . La Commission relève dès lors que les faits présentés par le requérant remontent à une date antérieure au 28 novembre 1974, qui est la date d'entrée en vigueur de la Convention à l'égard de la Suisse . Seules les décisions du Tribunal fédéral suisse statuant, d'une part sur le pourvoi en nullité, d'autre part sur le recours de droit public ont été rendues le jour même où entrait en vigueur la Convention . Toutefois, en statuant, le tribunal n'a ni fait application de la Convention ni constaté qu'il y a eu allégation d'une violation de la Convention par les autorités suisses . La Commission estime néanmoins ne pas devoir se déclarer incompétente ratione temporis pour examiner la requéte . Elle estime en effet que, postérieurement à la date d'entrée en vigueur de la Convention à l'égard de la Suisse, le requérant se trouve dans la situation continue de ne pouvoir pénétrer en Suisse pour y rendre visite à son épouse, qui y réside . La Commission rappelle à ce propos que si le droit général de pénétrer, de résider dans un pays déterminé et de ne pas en être expulsé ne figure pas en tant que tel, parmi les droits et libertés garantis par la Convention, les Etats contractants n'en ont pas moins accepté de restreindre le libre exercice des pouvoirs que leur confère le droit international général, y compris celui de contrôler l'entrée et la sortie des étrangers, dans la mesure et la limite des obligations qu'ils ont assumées en vertu de la Convention (cf . mutatis mutandis, la décision du 30 juin 1959 sur la recevabilité de la requête N° 434/58, Ann . 2, p . 373) . En l'espéce, le requérant se plaint d'étre séparé de son épouse et de ne pas obtenir l'autorisation de lui rendre visite .
Il se pose donc la question de savoir si la décision de refus des autorités suisses n'a pas dénié au requérant l'un des droits qui lui sont garantis par le Titre 1 - , particuliérement par les articles 8 et 12 de la Convention . Toutefois, le requérant n'a nullement démontré que le fait d'avoir dû quitter la Suisse constituait une ingérence dans sa vie privée et une entrave à sa vie conjugale . En particulier, il n'a pas expliqué pour quelles raisons son épouse aurait été empêchée de le rejoindre en République Fédérale d'Allemagne afin de rendre possible la vie conjugale . Il s'ensuit que la requête est, é cet égard, manifestement mal fondée au sens de l'article 27, § 2, de la Convention .
Summery of relevant facts The applicant, a German national, obtained both a residence and work permit in Switzerland in 1961 . He married a Swiss national in 1965 . He lost his job in 1968 and in 1970 the authorities in Argovy (Aargau) served him with a deportation order . This measure was suspended until autumn 1971 when the applicant wes effectivety forced to leave Switzerland and found himseff separated from his wife. The applicant then made short visits to his wife and in the cou rse of one of these was arrested and sentenced to detention by the court in Zofingen for breaking the order. After his appeal failed he entered a plea of nullity and a public law appeal to the Federal Court. Both were rejected.

(TRANSLATION) THE LAW The applicant complains essentially of the refusal by the Swiss authorities to allow him to visit his spouse residing in Switzerland, with regard to which he alleges a violation of Article 8 of the Convention . The interference with his right to family life could not in his case be justified under Article 8 (2) . Furthermore there had been a violation of Article 12 of the Convention in that the Swiss legislation failed to take account of the separation of spouses which would result from an expulsion . Finally he alleges a violation of Articles 5 and 6 in connection with his arrest, detention and conviction . The Commission notes in the first place that the facts alleged by the applicant relate to a date prior to 28 November 1974, the date on which the Convention entered into force with respect to Switzerland . Only the Swiss Federal Court's decisions on the plea of nullity and the public law appeal were given on the very day the Convention came into force . However, in giving its judgment the Court neither applied the Convention nor found that there had been an allegation of a violation of the Convention on the part of the Swiss authorities . Nevertheless, the Commission considers that it should not declare that it lacks jurisdiction ratione temporis to examine the application since, subsequent to the date of entry into force of the Convention with respect to Switzerland, the applicant finds himself in a continuing situation of not being able to enter Switzerland to visit his wife who resides there . In this connection the Commission recalls that though in generel the right to enter, reside in and not to be expelled from a given country is not as such included among the rights and freedoms guaranteed by the Convention the Contracting States nevertheless agreed to restrict the free exercise of powers conferred upon them by general international law including that of controllinq the entry and exit of aliens to the extent and within the limits of the obligations accepted under the Convention (cf . mutatis mutandis, the decision of 30 June 1959 on the admissibility of application N° 434/58, Yearbook 2, p . 373) . In the instant case the applicant is complaining of being separated from his wife and not being given authorisation to visit her . This raises the question wether this decision of the Swiss authorities has not denied the applicant one of the rights guaranteed to him under Section 1 and in particular by Articles 8 and 12 of the Convention . However, the applicant has in no way proved that the fact of having to leave Switzerland amounted to an interference with his private life and an obstacle to his married life . In particular, he has not explained for what reason his wife was prevented from joining him in the Federal Republic of Germany in order to render married life possible . It follows that this part of the application is manifestly ill-founded within the meaning of Article 27 (2) of the Convention .
