Person committed by judicial decision following innumerable indictments for insults, causing bodily harm, damage to property, etc . . . ending up certified as not being criminalN responsible .
Kept in detention because he was bound to break the law due to a serious personality disorder.
THE LAW The applicant has complained that he is wrongly detained in a mental hospital . It is true that Article 5 ( 1) of the Convention secures to everyone the right t o liberty . However, contrary to the applicant's opinion, his detention is in conformity with Article 5 111 (e) because it appears from the decisions of the German courts that the applicant is considered to be a person of "unsound mind" . It is true that according to the medical opinion submitted by him the applicant does not seem to be mentally ill . However, the notion"unsound mind" within the meaning of Article 5(1) (e) must be understood in a wider sense comprising also abnormal personality traits which do not amount to mental illness . Otherwise there would be no protection of the oublic against persons like the applicant, who according to the statement of psychiatric experts and the findings of the German courts, have the tendency to commit, andin . fact repeatedly commit, aggressive acts but cannot be held criminally responsible .

An examination by the Commission of this complaint as it has been submitted, including an examination made ex officio, does not therefore disclose any appearance of a violation of the rights and freedoms set out in the Convention and in pa rt icular in the above Article . It follows that the application is manifestly ill - founded within the meaning o f Article 27 (2) of the Convention . For these reasons, the Commissio n DECLARES THIS APPLICATION INADMISSIBL E
Résumé des faits Personne internée per décision judiciaire à la suite d'innombrables plaintes pour insultes, lésions corporelles, dommages à la propriété, etc. . . ayant généralement abouti à un constat d'irresponsabilité . Détention maintenue au motif que l'intéressé est tenté de commettre des infracrions par suite d'importants troubles cerectériels .
(TRADUCTION ) EN DROI T Le requérant se plaint d'être détenu à ton dans une clinique psychiatrique . II est vrai que l'article 5, § 1, de la Convention garantit à toute personne le droit à la liberté . Cependant, contrairement à ce que soutient le requérant, sa détention est conforme à l'article 5, § 1 lel, car il resson des décisions des tribunaux allemends, qu'il est considéré comme un rcaliénén . Il est vrai que selon un avis médical qu'il a produit, le requérant semble ne pas être un malade mental . Toutefois, la notion d'ualiénée, au sens de l'article 5 . § 1(e), doit étre interprétée dans un sens plus large, visant également les personnes qui présentent des anomalies du caractère ne constituant pas une maladie mentale . S'il en était autrement, le public serait dépourvu de protection contre les personnes du genre du requérant qui, aux dires des experts psychiatres et des tribunaux allemands, présentent une tendance à commettre - et, en fait, ne cesse de commettre - des actes de caractére agressif, sans pour autant pouvoir être considéré comme pénalement responsable . L'examen de la requête, y compris l'examen d'office auquel la Commission a procédé ne révèle donc aucune apparence de violation des droits et libertés garantis par la Convention et, en particulier, par la disposition précitéé . II s'ensuit que la requête est manifestement mal fondée, au sens de l'article 27, § 2, de la Convention .
Par ces motifs, la Commissio n DECLARE LA REOUETE IRRECEVABLE .
