The facts as they have been submitted by the applicant may be summarised as follows : Theapplicant is an Austrian citizen resident at B . Carinthia . She states that she belongs to the Slovene ethnic minority by virtue of her national origin although her mother-tongue is German .

1 . The applicant's first complaint concerns an Amendment to the Census Act (Anderung des Volksz6hlungsgesetzes, Federal Law Gazette No . 398/76), authorizing the census authorities to investigate the individual's mothertongue . The mother-tongue of Austrian citizens can also be investigated in a confidential procedure (Section 2 (3) of the Act as amended) . A"confidential mother-tongue census" (geheime Erhebung der Muttersprache) can be ordered by the Federal Government, with the consent of the Standing Committee of the Federal Parliament IHauptausschuss des Nationalrates), to be held in all or part of the Federal territory, as the need may be (Sections 9 111 c and 10 111 of the Act, as amended) . Unlike the procedure observed in the case of an ordinary census, this special census is organised in a similar way as general elections, and the provisions of the Federal Parliament Electoral Act INationalratswahlordnungl are applicable (Section 11) . Special safeguards are provided to prevent the identification of the individual's declaration, and the penal sanctions for false declarations which apply in the case of an ordinary census ISection 8/1) are not applicable (Section 8/2) . The above amendment to the Census Act was enacted by the Federal Parliament on 7 July 1976 and published in the Federal Law Gazette on 5 August 1976 . On 5 October 1976, the Federal Government with the consent of the Standing Committee of the Federal Parliament, ordered a special mother tongue census to be held throughout the Federal territory on 14 November 1976 (ordinance Federal Law Gazette No . 542/1976) . 2 . On . . October 1976, the applicant filed a constitutional appeal under Article 140 111 in (ine of the Federal Constitution as amended by the Constitutional Act, Federal Law Gazette No . 302/1975, Under this provision an individual person can apply to the Constitutional Court for a ruling on the constitionality of a law if it is claimed that the law in question is unconstitutional and interteres immediately, i .e . without the intervention of a judicial or administrative decision, with that person's rights . The applicant claimed that as German speaking Slovene she was so affected by the Amendment to the Census Act certain provisions of which she alleged were unconstitutional . She submitted in particular that the authorities' discretion when deciding whether or not to hold a special mother-tongue census was not sufficiently determined by law as required by Article 18 121 of the Federal Constitution, especially as there remained a possibility for the Administration to include the question as to the mother-tongue in an ordinary census, with the attached penal sanction . She further submitted that the only question asked in a special census concerned the individual's mother-tongue, thereby depriving him of the possibility to declare his belonging to an ethnic minority by virtue of other

than linguistic criteria . It was the declared aim of the above Amendment to the Census Act to establish an "objective and unbiased determination of the ethnic groups of non-German language living in Austria, with a view to the full implementation of the measures necessary under Article 7 of the State Treaty of 1955" 1"die objektive und unbeeinflusste Feststellung der in Osterreich lebenden Volksgruppen nichtdeutscher Sprachzugehbrigkeit im Hinblick auf die zur vollen Verwirklichung der aufgrund Artikel 7 Staatsvertrag 1955 notwendigen Massnahmen" - annotations of the Government Bill, Supplement No . 103 of the Parliament's shorthand transcript, 14th legislature, p .4) . Therefore, the result of the special census was intended to serve as the basis of measures concerning the ethnic minorities in Austria, in particular under the Ethnic Minorities Act (Volksgruppengesetz, Federal Law Gazette No . 396/1976) enacted on the same date as the above Amendment to the Census Act . In the applicant's view, the legislator's failure to take into account other than linguistic criteria in determining the membership of an ethnic minority violated the principle of equality (Article 7 of the Constitution) by introducing an unjustified distinction between members of the minority who speak another language than German and those who, while belonging to the minority, have adopted the German language as their primary means of expression . Moreover, it was alleged that it was also unreasonable to deprive bilingual citizens of the possibility of declaring more than one mother-tongue . Apart from a breach of the principle of equality, the applicant also alleged a violation of the constitutional provision of Article 7 of the State Treaty which ensures the special protection of ethnic minorities . For the above reasons, the applicant requested the Constitutional Court to declare null and void as being unconstitutional the provisions of the Amendment to the Census Act by which the special mother-tongue census had been introduced, and to declare null and void as being unlawful the Government's ordinance of 3 October 1976 . 3 . By an order of . . . November 1976, the Constitutional Court communicated the case to the Federal Government who were requested to submit observations within a period of six weeks . At the same time, the parties were informed that they would be summoned to the public audience by a separate order . However, after having obtained the Government's observations, the Constitutional Court refrained from fixing a public audience (Section 19 (3) No . 1 e of the Constitutional Court Act 1953) and decided in a closed meeting to reject the applicant's constitutional appeal as being inadmissible .
The Constitutional Court's decision of . . . June 1977 which was served upon the applicant on . . . July 1977 stated that the applicant had no locus standi . It was a condition for a constitutional appeal under Article 140 (1) in fine that the law complained of interfered with the rights of the applicant to his disadvantage . Only a person to whom the legal regulation in question was addressed and with whose Ilegally protected) interests it actually (an d

not only potentially) interfered was entitled to bring such appeal . In the present case, however, there was no interference with the applicant's rights . In tact, she had claimed a right to express her membership of the Slovene ethnic minority in connection with the mother-tongue census . However, a right to having available arrangements which include the possibility to confess the belonging to the Slovene ethnic group did not exist . The law in question gave everybody the right to participate in the confidential mothertongue census and did not impose any obligation on anybody . The contested regulations did not prevent the applicant, nor any other person, from confessing her or his belonging to the Slovene ethnic minority . If the result of the mother-tongue census was to be used for certain considerations of legal policy (including considerations concerning the treatment of ethnic minoritiesl, it could be that the regulations enacted on the basis of such considerations interfered with the applicant's rights to her disadvantage, but the samecould not be said of the regulations concerning the mother-tongue census itself . The applicant's reference to the Ethnic Minorities Act was therefore :irrelevant, the more so since that Act had only entered into force on 1 February 1977, i .e . after the confidential mother-tongue census of 14 November 1976 . 4 . The applicant now complains of the procedure adopted by the Constitional Court . She considers that the Court wrongly denied her locus standi, and that itfwrongly took its decision without a public hearing . In this respect she invokes~Articles 6 and 13 of the Convention and requests to be given her rights to aneffective remedy leading to a public hearing of her case . The-applicant further complains that the Amendment to the Census Act interfered directly with her personal rights and freedoms as a citizen and amounted twa degrading treatment within the meaning of Article 3 of the Convention by depriving her of the possibility to declare, as a Germanspeaking Austrian, her membership of the Slovene ethnic minority without denying the objective truth when replying to the specific mother-tongue question asked at the census . Allegedly the contested legal regulations put before her the choice, either to confess her belonging to the Slovene minority by-a false declaration, or to deny her real people by telling the truth . She considers this an attempt to corrupt her ethic and ethnic identity and her psychological, intellectual and moral health . She further complains that she is treated in-a unequal and biased manner in comparison with citizens with only one mother-tongue, by reason of having two mother-tongues . In her view, the so-called special type census is no census at all, as it imports a subjective elementinto an otherwise objective census procedure . It is rather a kind of a plebiscite ; and this is also shown by the fact that the preparations for the speciahtype census were conducted like a campaign in Carinthia . Moreover, the law. is a lex imperfecta as the penal sanctions otherwise provided for are inapplicable . Thus it enables and condones explicitly to give any answer o r

none at all, or knowingly untrue or incomplete statements . For these reasons, the applicant submits that she cannot be expected to acknowledge the regulations in question as law .The interpretation given to the relevant provisions by the Constitutional Court is, according to the applicant, ambiguous and self-contradictory . On the one hand, the Constitutional Court stated (without giving a reason) that a right to have available arrangements which include the possibility to confess the belonging to the Slovené ethnic group did not exist, but on the other hand it nevertheless recognised-as a kind of anti-right-the possibility to confess oneself as one pleases as a member of any ethnic group . The applicant submits that according to the explanation of the Constitutional Court she would have been able to state or confess either way merely a half-truth, whether she would have made a statement of having a Slovene or of having a German mother-tongue . She does not accept that there was no interference with her rights as suggested by the Constitutional Court . In fact, she claims that there has been interference with her fundamental right of personal dignity ; the honor, dignity and good ethic reputation being rights protected by the civil law and also the criminal law . Moreover, she claims that this has been an actual and not only potential interference with her rights .
THE LAW (Extract ) 1 . The applicant complains that the 1976 Amendment to the Census Act which introduced a confidential mother-tongue census amounts to degrading treatment within the meaning of Article 3 of the Convention because it put her in a situation where she allegedly had to choose between making a false declaration regarding her mother-tongue (German) or else to deny her allegiance to the Slovene minority .
It is true that Article 3 of the Convention provides that no one shall be subjected to, inter alia, degrading treatment . . However, the Commission observes that the applicant was not as such prevented from stating that she considered herself as a member of the Slovene minority . She only could not do this at the special mother-tongue census which was limited to finding out the language spoken by Austrian citizens . The Commission finds that the situation complained of falls outside the scope of the provisions of the Convention, and in particular Article 3 which the applicant has invoked . The Convention does not provide for any rights o f

a linguistic minority as such, and the protection of individual members of such minority is limited to the right no to be discriminated in the enjoyment of the Convention rights on the ground of their belonging to the minority (Article 14 of the Convention) . As in the present case there is no other Convention right at issue, the question of discrimination cannot arise . It follows that the applicant's above complaint is ratione materiae incompatible with the provisions of the Convention and must accordingly be rejected under Article 27 (2) of the Convention . 2 . The applicant further complains of the way in which the Constitutional Court dealt with the constitutional appeal which she had brought under Article 140 (1) of the Constitution against the 1976 Amendment to the Census Act . In particular she complains that the Constitutional Court took its decision without a public hearing, and that it denied her locus standi . In this respect she alleges breaches of Articles 6 and 13 of the Convention . Article 6 of the Convention provides that in the determination of his civil rights and obligations or of any criminal charge agains him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law . Article 13 of the Convention provides that everyone whose rights and freedoms as set forth in the Convention are violated shall have an effective remedy before a national authority . a . The Commission first observes that the proceedings taken by the applicant before the Constitutional Court did neither concern the determination of her civil rights and obligations, nor the determination of a criminal charge within the meaning of Article 6 111 of the Convention . In accordance with the consistent case law of the Commission (cf . e .g . the Commission's decision on the admissibility of applications No . 436/58, Collection of decisions 1 ; No . 673/59, Coll . 7, p . 98 and No . 742/60, Coll . 7, p . 104) proceedings of this kind do not come under the scope of Article 6, and therefore this part of the application must be rejected as being incompatible with the provisions of the Convention IArticle 27, para . 21 . b . As regards the alleged breach of Article 13, the Commission observes that this provision is only applicable where an applicant claims the violation ot the rights and freedoms set forth in the Convention . However, the Commission has already found above that the applicant's main complaint falls outside the scope of the Convention and therefore there is no room to apply Article 13 in the present case . This complaint is therefore again incompatible with the provisions of the Convention .

(TRADUCTION ) EN FAIT (Extraits ) Les faits, tels qu'ils ont é té présentés par la requérante, peuvent se résumer comme suit : La requérante, ressortissante autrichienne, réside à B . . ., Carinthie . Elle affirme appartenir à la minorité ethnique slovéne en raison de son origine nationale, sa langue maternelle étant toutefois l'allemand .
1 . Le premier grief de la requérante concerne un amendement à la loi de recensement (F+nderung des Vollkszïhlungsgesetzes, Gazette fédérale des lois N° 398/76), autorisant le Service du recensement à faire porter ses enquêtes sur la langue maternelle de la personne interrogée . La langue maternelle des ressortissants autrichiens peut également faire l'objet d'une enquéte confidentielle (article 2, paragraphe 3 de la loi, telle qu'amendée) . Un « recensement confidentiel de la langue maternelle » Igeheime Erhebung der Muttersprache) peut, avec l'accord de la commission permanente du Parlement fédéral (Hauptausschuss des Nationalrates), être ordonné par le Gouvernement fédéral sur tout ou partie du territoire, selon le cas larticles 9, paragraphe 1 cl et 10, paragraphe 1 de la loi telle qu'amendéel . A la différence de la procédure de recensement ordinaire, ce recensement spécial est organisé comme des élections générales et ce sont les dispositions de la loi électorale sur le Parlement fédéral (Nationalratswahlordnung) qui s'y appliquent (article 11) . En revanche, ne s'appliquent pas (article 8, paragraphe 2) les garanties particuliéres prévues pour empêcher d'identifier la déclaration de la personne interrogAe, ni les sanctions pénales prévues pour un recensement ordinaire en cas de fausses déclarations (article 8, paragraphe 1) . L'amendement précité à la loi de recensement fut voté par le Parlement fédéral le 7 juillet 1976 et publié au J .O . (Gazette fédérale des lois) le 5 aoùt 1976 . Le 5 octobre 1976, avec l'accord de la commission permanente du Parlement fédéral, le Gouvernement fédéral ordonna pour le 14 octobre 1976 sur toute l'étendue du territoire fédéral, un recensement spécial des langues maternelles (ordonnance publiée dans la Gazette fédérale des lois, N° 542/ 19761 . 2 . Le . . . octobre 1976, la requérante forma un recours constitutionnel conformément à l'article 140, paragraphe 1 in fine de la Constitution fédérale, tel qu'amendé par la loi constitutionnelle publiée à la Gazette fédérale des lois N° 302/1975 . Aux termes de cette disposition, tout individu peut demander à la Cour constitutionnelle de se prononcer sur la constitutionnalité d'une loi s'il prétend que le texte en question est contraire à la Constitution et porte atteinte à ses droits directement, c'est-à-dire sans l'intervention d'une décision administrative ou judiciaire . La requérante prétendait en effet que se s

droits en tant que slovéne de langue allemande se trouvaient ainsi affectés par l'amendement à la loi de recensement, dont elle alléguait l'anticonstitutionnalité de certaines dispositions . Elle faisait valoir notamment que le pouvoir discrétionnaire du Gouvernement qui décide d'organiser ou non un recensement spécial sur la langue maternelle n'est pas suffisamment défini par la loi, ainsi que l'exige l'article 18, paragraphe 2 de la Constitution fédérale, en ce sens notamment que l'administration a la possibilité d'inclure la question sur la langue maternelle dans un recensement général, en l'assortissant de la sanction pénale susdite . La requérante alléguait en outre que la seule question posée dans un recensement spécial concernait la langue maternelle de la personne interrogée, privant par lé-méme l'intéressé de la possibilité de déclarer son appartenance à une minorité ethnique en vertu de critéres autres que linguistiques . En effet, l'amendement précité de la loi de recensement a pour but déclaré de « définir de maniére objective et impartiale les groupes ethniques autres que les germanophones vivant en Autriche, afin de mettre pleinement en o:uvre les mesures nécessaires au regard de l'article 7 du Traité d'Etat de 1955 » ( « die objektive und unbeeinflusste Feststellung der in Osterreich lebenden Volksgruppen nichtdeutscher Sprachzugehôrigkeit im Hinblick auf die zur vollen Verwirklichung der auf Art . 7 Staatsvertrag 1955 notwendigen Massnahmen « - Annotation au projet de loi gouvernemental, supplément N° 103 au bulletin sténographique des débats du Parlement, 14• législature, p . 4) . Le recensement spécial se proposait donc de servir de base aux mesures relatives aux minorités ethniques en Autriche, notamment à la loi sur les minorités ethniques (Volksgruppengesetz, Gaz . Fed . des lois N° 396/ 1976) votée le même jour que l'amendement précité à la loi de recensement . Selon la requérante, le fait que le législateur ne tienne pas compte de critères autres que linguistiques pour déterminer l'appartenance à une minorité ethnique est contraire au principe d'égalité (art . 7 de la Constitution), puisqu'il introduit une distinction injustifiée entre les membres de la minorité qui parlent une langue autre que l'allemand et ceux qui, tout en appartenant à cette minorité, ont adopté l'allemand comme principal moyen d'expression . Elle faisait valoir en outre qu'il est également déraisonnable de priver les ressortissants bilingues de la possibilité de déclarer plus d'une langue maternelle . Outre une violation du principe d'égalité, la requérante alléguait également une violation de la disposition constitutionnelle de l'article 7 du Traité d'Etat, qui prévoit une protection particulière des minorités ethniques . Pour toutes ces raisons, la requérante demandait à la Cour constitutionnelle de déclarer nulles et non avenues, pour cause d'inconstitutionalité, les dispositions de l'amendement à la loi de recensement qui avaient introduit le recensement spécial sur la langue maternelle, et de déclarer nulle, comme contraire à la loi, l'ordonnance gouvernementale du 3 octobre 1976 .

3 . Par décision du . . . novembre 1976, la Cour constitutionnelle informa le Gouvernement fédéral de ce recours et lui demanda de soumettre ses observations dans les six semaines . En même temps, les parties furent informées qu'elles seraient convoquées à l'audience publique par décision séparée . Toutefois, après avoir reçu les observations du Gouvernement, la Cour constitutionnelle renonça à fixer une audience publique lart . 19, par . 3 N° 1/e de la loi de 1953 sur la Cour constitutionnelle) et décida en chambre du conseil de déclarer irrecevable le recours constitutionnel de la requérante . La décision prise le . . . juin 1977 par la Cour constitutionnelle et signifiée à la requérante le . . . juillet 1977 déclare que l'intéressée n'avait pas de locus standi . En effet, l'une des conditions pour présenter un recours constitutionnel, aux termes de l'article 140, paragraphe 1 in fine, est que la loi attaquée porte atteinte aux droits du demandeur . Est donc seule habilitée à former ce recours la personne visée par la réglementation en question et dont les intér@ts légaux se trouvent effectivement (et non seulement virtuellementl lésés . En l'espéce toutefois, il n'avait pas été porté atteinte aux droits de la requérante . En fait celle-ci, à l'occasion du recensement sur la langue maternelle, avait revendiqué' le droit d'exprimer son appartenance à la minorité ethique slovéne . Or, le droit au bénAfice de dispositions permettant de déclarer son appartenance au groupe elhique slovéne n'existe pas . La loi en question donne à chacun le droit de participer au recensement confidentiel sur la langue maternelle mais n'y oblige personne . La réglementation litigieuse n'empêche ni la requéranta ni quiconque de déclarer son appartenance à la minorité ethique slovéne . Si les résultats du recensement sur la langue maternelle devaient servir à certains objectifs de politique législative (y compris ceux concernant le traitement des minorités ethniques), il se pourrait qu'une réglementation décidée sur la base de telles considérations portât atteinte aux droits de la requérante ; mais tel ne saurait être le cas de la réglementation du recensement sur la langue maternelle . C'était donc en vain que la requérante invoquait la loi sur les minorités ethniques, d'autant que ce texte n'était entré en vigueur que le 1•, février 1977, c'est-A-dire postérieurement au recensement confidentiel du 14 novembre 1976 sur la langue maternelle . 4 . Devant la Commission, la requérante se plaint de la procédure suivie par la Cour constitutionnelle . Elle estime que c'est à tort que la Cour lui a dénié un locus standi et qu'elle a renoncé à tenir une audience publique . Elle invoque à cet égard les articles 6 et 13 de la Convention et demande à bénéficier du droit à un recours effectif aboutissant à ce que sa cause soit entendue publiquement .
La requérante se plaint en outre que l'amendement à la loi de recensement porte directement atteinte aux droits et aux libertés de sa personne e n

tant que citoyenne et équivaut à un traitement dégradant, au sens de l'article 3 de la Convention . En effet, ce texte la prive de la possibilité de déclarer, en tant qu'Autrichienne germanophone, son appartenance à la minorité ethnique slovéne sans nier la vérité objective dans sa réponse à la question posée lors du recensement spécial sur la langue maternelle . Elle prétend que la réglementation contestée l'oblige à choisir soit de confesser son appartenance à la minorité slovéne en faisant une fausse déclaration, soit de renier son vrai peuple en disant la vérité . Elle estime que le texte essaie par IÀ de porter atteinte à son identité éthique et éthnique et à sa santé psychologique, intellectuelle et morale . Elle se plaint en outre qu'ayant deux langues maternelles, elle soit traitée de maniére inégale et partiale par rapport aux citoyens autrichiens qui n'en ont qu'une . De son point de vue, le prétendu recensement spécial n'est pas un recensement, puisqu'il introduit un élément subjectif dans une procédure de recensement par ailleurs objective . Il s'agit plutôt d'une sorte de plébisciste, comme le montre également le fait que les préparatifs de ce recensement spécial ont été menés en Carinthie comme une campagne électorale . En outre, il s'agit d'une tex imperfecta, puisque les santions pénales habituellement prévues sont inapplicables en l'espéce . Elle permet et laisse expressément la possibilité de donner une réponse quelconque ou de n'en pas donner du tout, ou encore de faire sciemment des déclarations inexactes ou incomplétes . Aussi la requérante soutient-elle ne pouvoir reconnaître à la réglementation en question le caractére d'une loi . L'interprétation donnée par la Cour constitutionnelle aux dispositions visées est, selon la requérante, ambiguë et contradictoire . D'un côté, en effet, la Cour constitutionnelle affirme (sans en fournir de motif) qu'il n'existe aucun droit au bénéfice de dispositions permettant de déclarer son appartenance au groupe éthnique slovéne mais, de l'autre, elle reconnaît néanmoins, comme une sorte d'anti-droit, la possibilité de se reconnaitre comme on veut, membre d'un quelconque groupe éthnique . La requérante prétend que, selon l'explication donnée par la Cour constitutionnelle, elle aurait pu déclarer ou confesser en quelque sorte une demi-vérité, en déclarant qu'elle était soit de langue maternelle slovéne soit de langue maternelle allemande . Elle n'accepte pas l'idée qu'il n'y a pas eu atteinte à ses droits, comme le laisse entendre la Cour constitutionnelle . Elle prétend en fait qu'il y a bien eu atteinte au droit fondamental à la dignité de sa personne ; l'honneur, la dignité et la bonne réputation sont en effet des droits que protége le droit civil comme le droit pénal . Elle prétend en outre qu'il y a bien eu là une atteinte réelle, et non pas seulement virtuelle, à ses droits .

EN DROIT (Extrait ) 1 . La requérante se plaint que l'amendement de 1976 à la loi de recensement, qui introduit un recensement confidentiel sur la langue maternelle, équivaut à un traitement dégradant au sens de l'article 3 de la Convention, en ce qu'il la place dans une situation telle qu'elle est mise devant le choix entre une fausse déclaration concernant sa langue maternelle (1'allemand) ou la négation de son appartenance à la minorité slovène .
Il est vrai que l'article 3 de la Convention stipule notamment que nul ne doit être soumis à un traitement dégradant . Toutefois, la Commission fait observer que la requérante n'a pas été proprement empEchée de déclarer qu'elle se considére comme appartenant à la minorité slovène, mais seulement qu'elle n'a pu le faire lors du recensement spécial sur la langue maternelle, qui se bornait à déterminer quelle était la langue parlée par les ressortissants autrichiens . La Commission estime que la situation incriminée échappe aux dispositions de la Convention et notamment à l'article 3 invoqué par la requérante . La Convention ne reconnaît pas de droits à une minorité linguistique en tant que telle et la protection des membres de cette minorité se limite à ne pas faire l'objet d'une discrimination, dans la jouissance des droits reconnus par la Convention, en raison de leur appartenance à une minorité (article 14 de la Convention) . Comme en l'espèce, aucun autre droit garanti par la Convention ne se trouve en jeu, la question de la discrimination ne saurait se poser . Il s'ensuit que le présent grief est incompatible ratione materiae avec les dispositions de la Convention et doit donc être rejeté en vertu de l'article 27, paragraphe 2 de la Convention . 2 . La requérante se plaint en outre de la maniére dont la Cour constitutionnelle a examiné lerecours qu'elle avait formé, conformément à l'article 140, paragraphe 1 de la Constitution, contre l'amendement de 1976 à la loi de recensement . Elle se plaint notamment que la Cour constitutionnelle a pris sa décision sans audience publique et qu'elle lui a dénié un locus standi . Elle allégue à cet égard la violation des articles 6 et 13 de la Convention . L'article 6 de la Convention prévoit que, dans toute contestation portant sur ses droits et obligations de caractère civil ou sur le bien-fondé de toute accusation en matiére pénale dirigée contre elle, tdute personne a droit à ce que sa cause soit entendue publiquement, équitablement, et dans un délai raisonnable, par un tribunal indépendant et impartial établi par la loi . L'article 13 de la Convention stipule que toute personne dont les droits et libertés reconnus dans la Convention ont été violés a droit à l'octroi d'un recours effectif devant une instance nationale .

a . La Commission fait tout d'abord observer que le recours formé par la requérante devant la Cour constitutionnelle ne concernait ni une contestation sur ses droits et obligations de caractére civil, ni le bien-fondé d'une accusation en matiére pénale, au sens de l'article 6, paragraphe 1 de la Convention . Selon la jurisprudence constante de la Commission (cf . par exemple la décision de la Commission sur la recevabilité des requètes N° 436/5B, Recueil 1 ; N° 673/59, Rec . 7, p . 98 et N° 742/60, Rec . 7, p . 104), une procédure de ce genre ne reléve pas de l'article 6 . En conséquence, cette partie de la requête doit étre rejetée comme incompatible avec les dispositions de la Convention larticle 27, paragraphe 2) . b . Quant à la violation alléguée de l'article 13, la Commission fait observer que cette disposition n'est applicable que si le requérant se plaint de la violation de droits et libertés énoncés dans la Convention . Or, la Commission vient de constater que le principal grief de la requérante se situe en-dehors du champ d'application de la Convention, de sorte que l'article 13 n'est pas applicable en l'espèce . Ce grief est donc, lui aussi, incompatible avec les dispositions de la Convention .

Article 3 of the Convention : A long period of detention on remand imposed upon an elderly accused person in ill-health could, in certain circumstances, fall under Article 3. In the present case however the applicant was receiving appropriate medical attention .
Article 5, paragraph 3 of the Convention : a) Examination of the grounds that justify the accused being kept in detention on mmand, in particular the danger of absconding . b) If a competent authority is prepared to release the accused on bait, he must provide information about his resources. Failing this he cannot complain of his continuing detention on the basis that the amount fixed for bail is excessive. cl Even if the grounds given by the competent authorities justify keeping the accused in detention on remand, it is appropriate to examine whether this detention has not been unduly prolonged by the manner in which the authorities conducted the case, or, alternative/y, whether the length can be ascribed to the conduct of the accused himse/f . In this respect he would only be held responsible for a prolongation of the detention if he has acted abusivety or excessively.
