Summary of the relevant facts
The applicunt, a United Kingdom citizen of lndian origin, was admitted in 1972 to the University of B. . as a student for the degree of Bachelor of Technologr . Ne failed his examination at the end of the first vear as well as the resits. In view of his poor attendance at tutorials, the university authorities decided that the applicant would rtot be allowed to re-enter the Urtiversity. The Courts which the app(icaat seized declared that they had no jurisdiction in the ma tt er .
THE LAW (Extract )
The applicant's p ri ncipal complaint is that he is denied the ri ght to education ensured by Article 2 of Protocol No. 1 . He alleges that he ha s

suffered discrimination because of his national origin in respect of this right, contrary to Article 14 of the Convention which ensures the enjoyment of Convention rights and freedoms without discrimination on any ground . The Commission refers to the interpretation by the European Court of Human Rights in its judgment of 23 July 1968 on the merits of the Belgian Linguistic case as regards Article 2 of Protocol No . 1 . that it is not an absolute right to all forms of education : The negative formulation of the right indicate s "that the Contracting Parties do not recognise such a right to education as would require them to establish at their own expense, or to subsidise, education of any particular type or at any particular level . . . There never was, nor is now, therefore any question of requiring each State to establish . . . a system (of general and official education), but merely of guaranteeing to persons subject to the jurisdiction of the Contracting Parties the right, in principle, to avail themselves of the means of instruction existing at a given time . 'rhe Convention lays down no specific ôbligations concerning the extent of those means and the manner of their organisation or subsidisation . . . The first sentence of Article 2 of the Protocol consequently guarantees, in the first place, the right of access to educational institutions existing at a given time . " This right requires . however, regulation by the Stat e "regulation which may vary in time and place according to the needs and resources of the community and of individuals . It goes without saying that such regulation must never injure the substance of the right to education nor conflict with other rights enshrined in the Convention ." (The Law, paras . 3-5, of the said Belgian Linguistic case judgment .) In the light of these considerations the Commission is of the opinion tha t where certain, limited, higher education facilities are provided by a State, in principle it is not incompatible with Article 2 of Protocol No . I to restrict access'ihereto to those students who have attained the academic level required to most benefit from the courses offered . Applying this conclusion to the facts of the present case, the Commission notes that the applicant did have an opportunity to pursue the computer science course at B . University but he failed the first year examination requirements and had a poor attendance record at compulsory classes . He was not therefore considered of a sufficient academic standard for readmittance to the Universily to repeat the first year of these studies, although the University did not exclude the possibility that he pursue a different subject . The Commission does not consider therefore that the applicant was unreasonably refused access to university education .

It is true that the applicant has also alleged that the refusal to readmit hint to B . University was because he was not of English origin . However he has not submitted any evidence whatsoever that the decision taken by the University was for this reason . An examination of the applicant's complaint, as it has been submitted, does not therefore disclose any appearance of a violation of Article 2 of Protocol No . 1 in conjunction with Article 14 of the Convention . It follows that this aspect of the application is manifestly ill-founded within the meaning of Article 27, paragraph 2, of the Convention .
Résumé des faits pertinents Le requérant, ressortissant du Rovaume-Uni d'origine indienne, a été adntis en 1972 à l'Université de B. cornrne étudiarn aux cours de licence en techrrologie (Bachelor of Technology) . A la fin de lu prernii•re année, il échoua aux examens . Il échoua une seconde fois à!a session complémen[aire . Contpte tenu de sa faible particlpation aux cours, les autorités universimires décidèrerrt que le requérant ne serait pas admis à poursuivre ses études. Saisis par le requérant, les tribunuux se déclarèrent incontpétents .
(/RADUCTION) EN DROIT (Extrait ) Le requérant se plaint essentiellement de s'étre vu refuser le droit à l'instruction, garanti par l'article 2 du Protocole additionnel, du fait de son o rigine nationale . Il allègue que ; dans la jouissance de ce droit, il a été l'objet d'une discrimination, en violation de l'a rt icle 14 de la Convention, qui garantit la jouissance des droits et des libertés reconnus dans la Convention sans distinction aucurie . -230-
La Commission se réfère à l'interprétation que la Cour européenne des droits de l'homme, dans son arrêt du 23 juillet 1968 sur le fond de l'Affaire - relative à certains aspects du régime linguistique de l'enseignement en Belgique • . a donné de l'article 2 du Protocole additionnel, interprétation selon laquelle il n'existe pas un droit absolu à toutes les formes d'éducation : La formulation négative de ce droit signifi e • que les Parties Contractantes ne reconnaissent pas un droit à l'instruction qui les obligerait à organiser à leurs frais, ou à subventionner, un enseignement d'une forme ou à un échelon déterminés . . . Il ne pouvait et il ne peut donc être question d'obliger chaque Elat à créer . . . un système (d'enseignement général et public), mais uniquement de garantir aux personnes placées sous la juridiction des Parties•Contractantes le droit de se servir, en principe . des moyens d'instruction existant à un moment donné . Quant à l'étendue de ces moyens et à la manière de les organiser ou de les subventionner, la Convention n'impose pas d'obligations déterminées . . . La première phrase de l'article 2 du Protocole garantit par conséquent, en premier lieu, un droit d'accès aux établissements scolaires existant à un moment donné . • Ce droit appelle cependant une réglementation par l'Eta t
. réglementation qui peut varier dans le temps et dans l'espace en fonction des besoins et des ressources de la Communauté et des individus . Il va de soi qu'une telle réglementation ne doit jamais entrainer d'atteintes à la substance de ce droit, ni se heurter à d'autres droits consacrés par la Convention . • (EN DROIT, par . 3-5 de l'Arrêt sur l'Affaire • relative à certains aspects du régime linguistique de l'enseignement en Belgique • ) A la lumière de ces considérations, la Commission estime que si un Etat prévoit un système d'enseignement supérieur limité, la limitation du droit d'y accéder aux étudiants ayant acquis le niveau universitaire requis pour ti re r le plus grand bénéfice des cours proposés n'est pas en principe contraire à l'article 2 du Protocole additionnel . Appliquant ce principe aux faits de la présente affaire, la Commission note que le requérant a eu effectivement la possibilité de suivre le cours d'informatique à l'Université de B . mais qu'il a échoué aux examens de première année et qu'il avait été peu assidu aux cours obligatoires . L'Université a estinié qu'il n'avait pas un niveau suffisant pour être admis à redoubler cette première année d'études, mais ne s'est pas opposée à ce qu'il étudie une autre ntatière . La Commission n'estime donc pas que le requérant s'est vu refuser déraisonnablement l'accès à l'enseignement supérieur .

Il est vrai que le requérant a aussi allégué que le refus de sa réadmission à l'Université de B . était dû au fait qu'il n'était pas d'origine anglaise . Cependant, il n'a fourni aucun commencement de preuve montrant que la décision de l'Université était fondée sur ce motif . L'examen du grief du requérant, tel qu'il a été soumis à la Commission . ne révèle donc aucune apparence de violation de l'article 2 du Protocole additionnel, combiné avec l'article 14 de la Convention .
II s'ensuit que cet aspect de la requête est manifestement mal fondé, au sens de l'article 27, paragraphe 2 de la Convention .
