La requérante a une fille qui a elle-mérne un fils né hors mariage . lusqu'en 1977 la requérante, sa fille et son petit-j!s vivaient ensemble. L'enfant avait été placé sous tute(!e . Craignant que ('ertfant souffre des conflits qui avaient éclaté entre sa rrtère et sa grand'ntère et se fortdunt sur des rapports psychiàtrique et psychologique constataru un retard du dére(oppement rnenta/ de l'enfant, le tuteur décida de placer celui-ci dans un établissernent d'éducation spécialisé. Cette rnesure fut cortfirrnée par l'autorité tutélaire.
Un recours de dmit public de la requérante fut rejeté par le Tribunal fédéral en mai 1979. - 183 -
EN DROIT (Extrait) La requérante se plaint de la décision du tuteur pla ç ant son petit-fils dans un établissement d'éducation spécialisé . Elle allègue en substance que ceite décision constitue une ingérence injustifiée dans sa relation familiale avec l'enfant . Elle a saisi la Commission dans le délai de six mois à compter de la signification, le . . . octobre 1979, de l'arrêt du T ri bunal fédéral suisse du . . . mai 1979 rejetant le recours de droit public qu'elle avait formé à cet égard . Ainsi qué l'ont admis la Commission et la Cour européennes des Droits de l'Homme, la . vie familiale ., au sens de l'article 8 de la Convention, • englobe pour le moins les rappo rt s entre proches parents, lesquels peuvent y jouer un rôle considérable, par exemple entre grands-parents et petits-enfants . (Cour eur. D .H . . Affaire Marckx - Arrét du 13 juin 1979, Série A, N° 31 . par. 45) . L'a rticle 8 ne distingue pas . par ailleurs, entre famille . légitime • et famille . naturelle .(Arrêt Marckx cité, par . 31) . Il n'est pas contesté en l'espèce que, bien que n'ayant pas juridiquement la garde de l'enfant, la requérante a largement p ri s en charge son petit-fils et n'a cessé de s'en occuper, de sort e qu'il a existé et existe entre eux une vie familiale effective . La mesure de placement décidée par le tuteur constitue à n'en pas douter une ingérence dans cette vie familiale . Dans la présente affaire, la situation était complexe du fait que l'enfant avait en quelque sorte deux foyers, sa mère et sa grand-mère vivant depuis peu dans des résidences distinctes . Quoi qu'il en soit, il ressort des pièces versées au dossier que la décision du tuteur, confirmée par les différentes autorités et juridictions de recours, a été prise après un examen attentif de plusieurs rapports psychologiques et psychiatriques : qu'elle a pour objet de pallier un retard de développement mental constaté chez l'enfant, nécessitant les soins d'un personnel spécialisé qu'elle semble avoir eu déjà des résultats positifs . Eu égard à ces différents éléments, la mesure provisoire et révisible prise par le tuteur apparaît comme étant nécessaire pour la protection de la santé de l'enfant et justifiée au regard de l'article 8, paragraphe 2, de la Convention . Il s'ensuit que la requête est, sur ce point, manifestement mal fondée au sens de l'article 27, paragraphe 2, de la Convention .

Summary of the relevant facts The applicant has a daughter who, in turn, has a son born out of wedlock . Urrti/ 1 977 the applicant, her daughter and her grandchild lived together. The child had been placed under guardianship . Fearing that he suffered,froni the disputes which had arisen between the child's rnother arrd grandmother aud basing himselj on the psychiatric and psychological reports pointiug to a retarded mental development of the child, the guardian decided to place him in a specialised education centre. This measure was confirmed by the guardianship authorities . A public law appeal introduced bv the applicant was rejected by the Federal Court in May 1 979.

THE LAW (Extract ) The applicant complains of the decision by her grandson's guardian to place the child in a special school . She alleges that this decision constitutes unjustified interference in her family relationship with the child . She lodged the application with the Commission within six months of notification, on . . . October 1979, of the Swiss Federal Court's judgment of . . . May 1979 dismissing her public law appeal on this question . As the European Commission and Court of Human Rights have held, "family life", within the meaning of Article 8 of the Convention, "includes at least the ties between near relatives, for instance between grandparents and grandchildren, since such relatives may play a considerable part in family life" (Eur . Court H .R ., Marckx case, judgment of 13 June 1979, Series A, No . 31, paragraph 45) . Moreover, Article 8 ntakes no distinction between the "legitintate" and the "illegitimate" family (Marckx case judgment, paragraph 31) . It is not disputed in the instant case that, although she does not have legal guardianship of the child, the applicant has largely assumed responsibility for her grandson and has continuously cared for him, with the result that a real family life existed and still exists between them . The placement decided upon by the guardian undoubtedly constitutes interference with this family life . The situation in the present case was complicated because the child to sonie extent had two homes since his mother and grandmother had since a short time been living separately .

Be that as it may . it emerges from the documents in the file that the guardian's decision, upheld by the various autho ri ties and appeals bodies was taken after close examination of several psychological and psychiatric repo rt s ; the purpose of the decision was to offset retarded mental development observed in the child and necessitating care by specialised staff ; moreover the decision already seems to have had positive results . In view of these va ri ous factors, the temporary and reviewable step taken by the guardian appears to be necessa ry for protection of the child's health and justitied under A rt icle 8, paragraph 2 of the Convention . It follows that, on this point, the application is manifestly ill-founded within the meaning of Article 27, paragraph 2 of the Convention .
