Summa ry of the facts
The applicant* was prosecuted in Saarbrucken . Trier and Cologne jbr a series oj' crinrirral offences oj' a similar natnre . Considering that the applicant had recently been convicted in Trier and Saarbruckert . the Cologne Court terminated proceedittgs for reasons of procedural economy while stating that the sertterrce it wottld have pronounced

would have been of ve ry little import ance compared with the ones imposed on hint in the two other towns . The applicant then requested compensation for the approximately /3 months which he had spent in detention on remand in the frarnework of the proceedings instituted in Cologne. The court rejected the claim holding that given the penalties inJlicted, the detention on remand spent and the possibilities ojbeing released on parole . the applicant's situation had not substantially worsened and that another tria l had thus been avoided. THE LA W The applicant complains of the refusal of the German judicial authorities to grant him compensation under the Act on Compensation in Criminal Ma tt ers ( StrEG) for his detention on remand in criminal proceedings before the Cologne Regional Cou rt , proceedings which were eventually discontinued . He considers that this refusal, and in pa rticular the reasons stated by the competent cou rt s, violate the principle of presumption of innocence (Art . 6(2)) as these reasons contained an appreciation as to his guilt . The applicant has exhausted domestic remedies and respected the six months tinte-limit as he raised this complaint before the competent appellate court and also before the Federal Constitutional Court . The latter court rejected his appeal on 2 April 1980 and the application with the Commission was lodged within six months from that date, namely on I September 1980 . As regards the alleged violation of Article 6 (2), the Commission first observes that no right to compensation for lawful detention on remand is as such included among the rights and freedoms guaranteed by the Convention and a decision of a national authority denying such compensation does therefore not per se violate any of the provisions of the Convention . If such decision is, however, as is alleged in the present case, motivated by an appreciation of guilt, the question arises whether Article 6 (2) of the Convention protects a person who has not been convicted by a final judgment against any formal acknowledgement of his guilt in any form whatever (cf . Report in the case of Adolf v . Austria, No . 8269/78, para . 56) . The Commission has already declared admissible two analogous applications conceming decisions on incidental expenses (notwendige Auslagen) occurring in the decisions in question that "the accused would normally have been convicted" (Liebig, D .R . S . pp . 58 . 64) and that "the result of the investigations and the findings of the trial court made it appear that the conviction (which did not become final) was justified" (Neubecker, D .R . S . pp . 13, 24), respectively . The Commission was, however, not required to express an opinion in the said cases as a friendly settlement was reached .

A third application of the kind (N° 8660/79, Minelli v . Switzerland, D .R . 21 . p . 199) was recently declared admissible . This application related to crintinal proceedings which were barred by the statute on limitations . The applicant being the defendant in the criminal proceedings was ordered to pay part of the costs of the proceedings and compensation (Prozessentschtidigung) to the private parties (Privatklüger) . This decision was also based on the ground that the applicant would probably have been convicted . In support of this reasoning reference was made to the result of other criminal proceedings in which other defendants had been convicted on the basis of facts analogous to those underlying the charges which had been levelled against the applicant . The Commission nevertheless considers that the present application is distinguishable from the applications cited, in particular from Application No . 8660/79 . and that it does not raise the same problems . In the present case the courts did not refer to convictions of other persons but to convictions of the applicant himself, namely to his convictions of fraud in a total of 126 cases, pronounced in separate proceedings in Trier and Saarbrucken . These convictions which became flnal undisputedly concerned uniform business transactions carried out under the pattern of the socalled Eckle-system . The Cologne proceedings, which were discontinued, also related in part to the Eckle-system . The reasoning of the Cologne Regional Court that in all probability the applicant would again have been convicted was expressly limited to those charges raised in the Cologne proceedings which were connected to the Eckle-systeni, nantely 55 counts of fraud, while with regard to all other charges the court avoided any appreciation . With regard to the 55 fraud charges the court stated that the individual cases were committed in the same way as the 126 fraud cases of which the applicant had already been held guilty . The applicant has not alleged either in his appeal against the Cologne Regional Court's decision of 27 December 1979 or in his constitutional appeal or in his submissions to the Commission, that in view of the institution of the Trier and Saarbrucken proceedings or in view of their result he had altered his business practice known as the Eck1e-system so as to avoid further convictions .
In these circumstances the Commission considers that the applicant's final convictions in two similar criminal proceedings distinguish the present case from the previous matters mentioned above . In addition the case is distinguishable from Application No . 8660/79 in that the decision complained of here related to the question of compensation for a measure taken against the applicant in the past while the decision complained of in the said application concerned a new measure, namely the order to pay part of the court costs as well as the costs of private parties . In the present case the Regional Court's and the appellate court's reasoning insinuating the likelihood of a conviction did not in the Com-

mission's opinion substantially affect the applicant's situation which was and is marked by the fact that his so-called Eckle-system was held to be fraudulent in two final judgments . In these particular circumstances the Commission cannot find that the decisions complained of amount to a violation of the principle of presumption of innocence . An examination by the Commission of this complaint as it has been submitted does not therefore disclose any appearance of a violation of the rights and freedoms set out in the Convention and in particular in Article 6 (2) . It follows that the application is manifestly ill-founded within the meaning of Article 27 ( 2) of the Convention . For these reasons, the Commissio n
DECLARES THIS APPLICATION INADMISSIBLE .
Résruné des taits Le requérant* a été poursuivi à Sarrebruck . Trêves et Cologne pour une série d'uctes délictueux de même nature . Considérant que le reqnérant venait d'étre condamné à Trêves et à Saarbruck, le tribuwtal de Cologne a rnis fin aux poursuites pour des raisons d'économie . tout en emrstatant que la peine qu'il aurait eu à prononcer aurait été très peu irnportante en cornparaison de celles prononcées dans les deu .r autres villes . Le requérant dernanda alors une indenurité pour les quelque 13 mois qu'il avait pussés en détention préventive dans le cadre de la procédure ouver(e à Cologne. Le tribtural rejeta la demande après avoir constaté que, comple tenu des peirtes prorroncées, de la détention préventive subie et des possibilités de libératiorr couditionnelle dans le cadre des autres poursuites, la situation du requérant n'élait pas notablement agravée et qu'un nouveau procès lui avait été épargné.

(TRADUCTION) EN DROI T Le requérant se plaint du refus par les autorités judiciaires allemandes de lui accorder réparation au titre de la loi sur l'indemnisation en matière pénale (StrEG) pour la détention provisoire qu'il a subie pendant les poursuites pénales engagées devant le tribunal régional de Cologne et finalement abandonnées . 11 estime que ce refus, et notamment les raisons qu'en ont données les tribunaux compétents, violent le principe de la présomption d'innocence (article 6 . paragraphe 2) car dans les considérants figure une appréciation sur sa culpabilité .
Le requérant a épuisé les voies de recours internes et respecté le délai de six ntois, puisqu'il a soulevé ce grief devant la cour d'appel compétente et égalentent devant la Cour constitutionnelle fédérale . Cette dernière juridiction a rejeté son pourvoi le 2 avril 1980 et la requête devant la Commission a été introduite dans les six mois à partir de cette date, le 1 - septembre 1980 exactement . S'agissant de la violation alléguée de l'article 6 . paragraphe 2, la Comtnission remarque tout d'abord que . parmi les droits et libertés qu'elle consacre, la Convention ne garantit pas, en tant que tel, le droit à indemni . sation pour une détention provisoire régulière et que la décision d'une instance nationale refusant cette indemnisation n'enfreint donc en soi aucune des dispositions de la Convention . Cependant . si cette décision est motivée, comme le requérant le prétend en l'espèce . par une appréciation de la culpabilité de l'intéressé, la question se pose de savoir si l'article ti, paragraphe 2, de la Convention protège la personne non condamnée par un jugement définitif contre toute constatation forntelle de sa culpabilité sous quelque forme que ce soit (cf . rapport dans l'affaire Adolf c/Autriche N° 8269/78, paragraphe 56) . La Commission a déjà déclaré recevables deux requétes analogues concernant des décisions sur les débours (notwendige Auslagen) exposés lors de poursuites pénales qui se terntinèrent par un non-lieu . Les décisions en question déclaraient que - l'accusé aurait normalentent été condamné » (Liebig, Décisions et Rapports 5, pp . 58, 6 3) et que « le résultat de l'enquéte et les constatations du premier juge avaient justifié sa condamnation (qui n'était pas devenus définitive) (Neubecker, Décisions et Rapports 5, pp . 13 . 14) . La Commission n'était toutefois pas tenue d'exprimer un avis dans ces deux affaires, puisqu'un règlentent amiable était intervenu . Une troisième requ@te de ce genre (N° 7660/79, Minelli c/Suisse, Décisions et Rapports 21, p . 199) a récemment été déclarée recevable ; elle portait sur des poursuites atteintes par la prescription . Le requérant, défendeur dans les poursuites pénales, avait été condamné à payer une partie de s

frais de justice et de l'indemnité de procédure (Prozessentsch3digung) aux particuliers auteurs des poursuites (Privatklàger) . Le tribunal avait également invoqu8 comme motif la condamnation probable du requérant . A l'appui de ce raisonnement, il faisait référence aux résultats d'autres poursuites pénales dans lesquelles d'autres défendeurs avaient été condamnés sur la base de faits analogues à ceux sur quoi se fondaient les accusations portées contre le requérant . _ La Contmission estime cependant que la présente requête se distingue des affaires rappelées ci-dessus, notamment de la requête N° 8660/79, et qu'elle ne pose pas les mêmes problèmes . En l'espèce en effet, les tribunaux ne se sont pas référés aux condamnations d'autres personnes mais à celles du requérant lui-même, c'est-à-dire à ses condamnations pour escroquerie dans 126 cas au total, prononcées dans des procès distincts, tenus à Tréves et Sarrebruck . Ces condamnations, devenues définitives, concernent incontestablentent des opérations commerciales du même type nienées selon le modèle appelé a système Eckle » . De m@me, les poursuites de Cologne, qui se terminèrent par un non-lieu, concernaient pour partie le système Eckle . Le raisonnement du tribunal régional de Cologne, selon lequel le requérant aurait très probablement été à nouveau condamné, se limitait expresséntent aux accusations portées dans le procès de Cologne et liées au système Eckle . à savoir 55 chefs d'escroquerie, le tribunal ayant évité de porter une quelconque appréciation sur les autres accusations . Quant au 55 accusations d'escroquerie . le tribunal déclare que, dans chaque cas, les modalités de commission du délit étaient identiques à celles des 126 cas d'escroqueries dont le requérant avait déjà été reconnu coupable . En interjetant appel de la décision rendue par le tribunal régional de Cologne le 27 décembre 1979, en formant un pourvoi constitutionnel ou en présentant ses griefs à la Commission, le requérant n'a pas allégué qu'au vu des procédures engagées à'rrêves et à Sarrebruck ou de leurs résultats, il ait jamais modifié la pratique comnterciale connue sous le nom de - système Eckle » . de façon à éviter de nouvelles condamnations .
Dans ces conditions, la Commission estime que les condamnations définitives du requérant dans deux cas de poursuites pénales analogues distinguent la présente requéte des affaires précédemment mentionnées . L'affaire se distingue aussi de la requête N° 8660/79 en ce sens que la décision visée en l'espèce porte sur une indemnisation pour une mesure prise dans le passé à l'encontre du requérant alors que la décision incriminée dans la requête précitée portait sur une mesure nouvelle, à savoir l'ordre d'acquitter en partie les frais de justice ainsi que ceux des particuliers auteurs des poursuites . En l'espèce la Comntission est d'avis que le raisonnement du tribunal régional et de la cour d'appel, laissant entendre qu'une condamnation était vraisemblable, n'a pas sensiblement affecté la situation du requérant . caracté-

risée par le fait que le système dit « système Eckle - a été reconnu frauduleux par deux jugements définitifs . Dans ces conditions particulières, la Commission ne saurait estimer que les décisions incriminées équivalent à une violation du principe de la présomption d'innocence . L'examen par la Commission de ce grief, tel qu'il a été présenté, ne révèle donc aucune apparence de violation des droits et libertés inscrits dans la Convention, notamment en son article 6 . paragraphe 2 . Il s'ensuil que la requéte est manifestement ntal fondée, au sens de l'article 27, paragraphe 2, de la Convention . Par ces motifs, la Commissio n DÉCLARE LA REQUÉTEIRRECEVABLE .
