Article 6, peragraph I of the Convention : The length of civil proceedings involving a request for pecuniary damages must be assessed in the light of the proceedings as a whole, even if the courts divided them into two parts, one part concerning the question of liability and the other concerning the actual amount of damages to be paid. However the length of a separate procedure concerning only the grant of legal aid for an appela is not taken into account . The question of the methods by which the applicant could have accelerated the proceedings concerns the merits of the application . Article 26 of the Convention :/n respect of the length of civil proceedings, the question of the methods by which the applicant could have accelerated the proceedings is not one which concerns the problem of exhaustion of domestic remedies. On the same hypothesis, a constitutional appeal may be considered an effective remedy in the Federal Republic of Germany . The six months' period therefore runs, in this case, from the date of the decision of the Federal Constitutional Court.
Article 6, para®raphe 1, de la Convention : La durée d'une procédure civile concernant une demande en dommages-intér@ts doit être appréciée dans son ensemble, alors même que les tribunaux ont scindé la procédure en deur parties, l'une sur le principe de la réparation, l'autre sur le montant de l'indemnisation . Par contre, la durée d'une procédure distincte ne portant que sur l'octroi de l'assistance judiciaire pour exercer un recours n'a pas à étre prise en considération .Laquestiond moyens que le requérant aurait pu utiliser pour accélére r la procédure relève de l'appréciation du bien-fondé de la requ@te.

Article 26 de la Convention : S'agissant de la durée d'une procédure civile, la questiort des moyens que le requérant aurait pu utiliser pour accélérer, la procédure ne relève pas du problème de l'épuisement des voies de recours internes.
Dans la méme hypothèse, un recours constitutionnel peut être considéré comme un recours efficace en République Fédérale d'Allemagne. Le délai de six mois coun donc, en ce cas, à partir de la décision de la Cour constitutionnelle fédérale .

Victime d'un accident du travail en 1962, le requérant* a actionné e n dommages-intéréts en 1964 l'installateur électricien qu'il estimait responsable. Par un jugement partiel (Grund- und Teilurteil) rendu en janvier 1967, le tribunal régional a déclaré l'action fondée, a accordé au requérant 5 000 DM à titre de réparation du tort moral et a renvoyé à un jugement ultérieur la détermination des dommages-intérêts . En appel (arrêt rendu en novembre 1969) l'indemnité pour tort moral fut portée à 50 000 DM. mais la Cour fédérale de justice la ramenaà 5 000 DM et déclara prescrite une partie des prétentions du requérant (arrêt rendu en septembre 1969) . Par un nouvel arrét rendu en mai 1972, la cour d'appel renvoya au tribunal régional la question de la fixation des dommages-intér€ts pour perte de gain . En janvier 1973, la Cour fédérale de justice refusa au requérant le bénéfice de l'assistance judiciaire pour se pourvoir contre le deuxième arrBt d'appel. En janvier 1974, le tribunal régional accorda au requérant une indemnité de plus de 50 000 DM et une rente. Sur appel du défendeur, l'indemnité fut réduite de moitié (arrét rendu en juin 1978) . En avril 1979, la Cour fédérale de justice refusa derechef au requérant le bénéfice de l'assistance judiciaire pour se pourvoir contre le troisième arr@t d'appel, jugeant un pourvoi dénué de chances de succès . Par un recours constitutionnel, le requérant se plaignit de cette décision, du calcul des dommages-intér@ts et de la durée de la procédure . Trois juges de la Cour constitutionnelle fédérale rejetèrent ce recours en novembre 1979. La requête à la Commission a été introduite le 7 mai 1980.

EN DROIT (Extrait ) Sur l'article 26 de la Convention . 3 . Le Gouvernement objecte que la requête ne satisfait pas aux conditions de l'article 26 de la Convention en ce que le requérant n'aurait formulé, durant la procédure, aucune demande visant à accélérer celle-ci et que son recours constitutionnel n'était pas, en l'espèce, un recours approprié pour se plaindre de la longueur de la procédure . Aux termes de l'article 26 • la Commission ne peut être saisie qu'après l'épuisement des voies de recours internes, tel qu'il est entendu selon les p ri ncipes de droit interna tional généralement reconnus et dans le délai de six mois, à part ir de la date de la décision interne définitive . . La Commission estime que l'argument tiré des moyens que le requérant aurait pu utiliser, le cas échéant, pour faire accélérer la procédure ne ressortit pas au problème de l'épuisement des voies de recours intemes, mais à celui du bien-fondé de la requête, c'est-à-dire au point de savoir si la durée du procès a dépassé un délai raisonnable . Elle relève d'autre part que le requérant a saisi la Cour constitutionnelle d'un recours dans lequel il se plaignait expressément de la longueur de la procédure . La Cour constitutionnelle, par sa décision du . . . novembre 1979, n'a pas rejeté ce recours pour non-épuisement des voies de recours ordinaires, mais au motif qu'il ne présentait pas de chancessuffisantes de succès . Dans ce rtaines affaires portées devant la Commission et posant le problème de la longueur de la procédu re , le recours constitutionnel a été considéré comme un recours que l'intéressé devait exercer pour sa ti sfaire aux exigences de l'article 26 de la Convention (cf . p . ex . n° 7614/76, Nagel c/R .F .A ., D .R . 12, pp . 77, 85 et n' 8130/78, Eckle c/R .F .A ., D .R . 16, pp . 120, 138) . Selon la jurisprudence de la Commission, il appa rtient au requérant de tenter un recours même lorsqû il existe un doute sur son efficacité . Dans la présente affaire, la Commission estime que par l'échec de son recours constitutionnel le re quérant a é puisé les voies de recours intemes et que la décision du comité des trois juges de la Cour constitutionnelle du . . . novembre 1979 constitue la décision inteme définitive, au sens de l'article 26 de la Convention . Pa rtant, le délai de six mois a été respecté . Sur l'article 6, paragraphe 1, de la Convention a) Période à prendre en considératio n 4. Le Gouvemement soutient qu'il s'est agi en l'espèce de deux procédures distinctes, la première ayant pris fin par l'arrêt du . . . mai 1972 concernant le bien-fondé de l'action, la seconde concernant le restant de l'action . Cette demière seule pourrait être soumise à l'appréciation de la Commission .

La Commission rappelle que la requête concerne la longueur d'une procédure que le requérant a intentée pour réclamer des dommages-intéréts . Le tribunal a, sur demande des parties, tranché dans un premier 'temps lâ question de savoir si les prétentions du requérant étaient fondées quant à leur principe . Sur recours, la cour d'appel, par l'arrét du . . . mai 1972, a jugé la demande fondée, condamné le défendeur à verser au requérant 5 000 DM de pretium doloris et renvoyé au tribunal de premiére instance la question du montant du manque à gagner et des frais . Celle-ci a fait ensuite l'objet d'un jugement final . Le but auquel le requérant tendait dès l'introduction de l'action ne pouvait donc étre atteint que par ce second jugement . Dans ces conditions, la Commission estime que la division de la procédure en deux phases pour des raisons d'ordre essentiellement pratique n'a pas eu pour effet de donner lieu à deux procès distincts dont la durée devrait être appréciée séparément sous l'angle de l'article 6, paragraphe 1 . En conséquence, le point de départ de la période à prendre en considération est le . . . avril 1964, jour où le requérant a intenté l'action, en demandant conjointement l'assistance judiciaire (cf . n° 1794/63, Ann . 9, pp . 181, 197, 211) . Quant au terme du délai, la Commission rappelle d'abord que selon sa jurisprudence, l'article 6, paragraphe 1, n'est pas applicable à la procédure devant la Cour constitutionnelle (cf . n° 8410/78, D.R . 18, pp . 216, 222 et rapport dans l'affaire Buchholz du 14 mai 1980, paragraphe 93 ; ef . également Cour eur . D .H ., arrêt Buchholz du 6 mai 1981, Série A, n° 42, paragraphes 47 et 48) . La Commission estime d'autre part que la procédure précédente devant la Cour fédérale de ]ustice, concernant uniquement la demande d'assistance judiciaire du requérant en vue d'un pourvoi en cassation, n'avait pas d'vectement trait à une contestation sur des droits et obligations de caractère civil (cf . n° 3925/69, Recueil de décisions 32, pp . 56, 59) . ll s'ensuit que le terme final de la période à prendre en considération est l'arrêt du . . . juin 1978 par lequel la cour d'appel a définitivement statué sur les prétentions du requérant . La procédure à examiner sous l'angle de l'article 6, paragraphe l, a donc duré quatorze ans, un mois et six jours .

Summary of the facts After an accident at work in 1962, the applicant instituted an action for damages in 1964 against the installations' electrician whom he held to be responsible . In a partial judgment in liability (Grund- und Teilurteil) in January 1967, the Regional Court declared the lawsuit well founded, granted the applicant 5000.-DM in non-pecuniary damages and deferred a decision as to the amount of the pecuniary damages.
On appeal (judgment delivered in November 1969) the amount of compensation for non-pecunia ry damages was raised to 50000.-DM, but the Federal Court oflustice reduced this to 5000.-DM and declared part of the applicant's claim to be covered by the statute of limitations (judgment of September 1969) . In a new judgment given in May 1972. the Court of Appeal referred the determination of the amount of damages for loss of earnings to the Regional Court . In January 1973, the Federal Court of Justice refused to grant legal aid to the applicant to appeal againrt this second judgment on appeal. In January 1974, the Regional Cou rt granted the applicant compensation of over 50000.-DM and an annuity . On the defendant's appeal the allowance was reduced by half (/udgment of June 1978) . In April 1979, the Federal Court of Justice again refused to grant the applicant legal aid to appeal against this third judgment on appeal on the grounds that such an appeal had no chance of success . The applicant lodged a constitutional appeal against this decision, the amount of pecuniary damages and the length of proceedings. Three judges of the Federal Constitutional Court rejected this appeal in November 1979 . The application was introduced before the Commission on 7 May 1980.

THE LAW (Extract ) As to Article 26 of the Convention . 3. The Government contends that the application does not meet the requirements of Article 26 of the Convention in so far as the applicant at n o

time requested the proceedings to be speeded up and in so far as his constitutional appeal was not an appropriate remedy for a complaint about the length of the proceedings . According to Article 26 "the Commission may only deal with the matte r after all domestic remedies have been exhausted according to the generally recognised rules of international law, and within a period of six months from the date on which the final decision was taken" . The Commission considers that the argument, based on the methods by which the applicant, in appropriate circumstances, could have speeded up the proceedings, does not relate to the problem of the exhaustion of domestic remedies but to that of the substance of the application, in other words whether the duration of the proceedings exceeded a reasonable time . It notes, firstly, that when the applicant appealed to the Constitutional Court, he expressly complained about the length of the proceedings . In its decision of . . . November 1979, the Constitutional Court did not reject this appeal on the grounds of non-exhaustion of the ordinary remedies but on the grounds that it did not have sufftcient prospects of success . In some cases brought before the Commission in which the problem of the length of the proceedings has been posed, the constitutional remedy has been regarded as one which the person concerned should exercise in order to meet the requirements of the Convention (cf. for example Application No . 7614/76, Nagel v . Federat Republic of Germany, D .R . 12 . pp . 77, 95 and No . 8130/78, Eckle v . Federal Republic of Germany, D .R . 16 . pp . 120, 128) . According to the Commission's jurisprudence, an applicant is required to lodge an appeal even though its effectiveness may be in doubt . In the present case, the Commission considers that with the failure of his constitutional appeal, the applicant has exhausted domestic remedies and that the decision of the threejudges of the Federal Constitutional Court of . . . November 1979 constitutes the final decision referred to in Article 26ofthe Convention . Furthermore, the period ofsix months was observed . As to Article 6(1) of the Convention . a . Period to be taken into conrideratio n 4 . The Government argues that there were to distinct sets of proceedings in this application, the first ending in the judgment of . . . May 1972 concerning the substance of the case, and the second concerning the remainder of the proceedings . Only the latter could be dealt with by the Commission . The Commission recalls that the application concerns the length of proceedings which the applicant started in order to claim damages . The court, at the parties' request, initially gave a ruling as to whether the applicant's claims were well founded in principle . The Appeal Court, in its judgment of . . . May 1972, ruled that the application was well founded, sentenced th e

defendants to pay the applicant 5000 .-DM as pretium doloris and referred the question of the amount of loss of earnings and expenses to the court of first instance . The latter question was then the subject of a final judgment . Thus the aim which the applicant pursued when starting his action could be achieved only by the second judgment . This being so, the Commission considers that the division of the proceedings into two phases, for largely practical reasons, did not have the effect of giving rise to two distinct sets of proceedings or that the length of each would need to be considered separately under Article 6 (1) . Consequently, the period under review must be regarded as starting o n . . . April 1964, the day on which the applicant started his case, together with a request for legal aid (cf. Application No . 1794/63, Yearbook 9, pages 180, 210) . As to the end of the period to be taken into account, the Commission first recalls that according to its jurisprudence, Article 6(1) is not applicable to the proceedings before the Constitutional Court (cf. Application No . 8410/78, D .R . 18, pp . 216 . 218 and Report in the Buchholz case of 14 May 1981, para . 93 ; see also Eur . Court H .R ., Buchholz judgment of 6 May 1981, Series A, paras . 47 and 48) . The Commission further considers that the earlier proceedings before the Federal Court of Justice, concerning only the applicant's request for legal aid with a view to an appeal, was not directly related to the determination of his civil rights and obligations (cf. No . 3925/69 1 Colf . Dec . 32, pp . 56, 59) . It follows that the period to be taken into accouht terminates with the judgment of . . . June 1978 by which the Appeal Court gave the final ruling on the applicant's claims . The proceedings to be considered from the standpoint of Article 6 (1) therefore took 14 years, one month and six days to complete .
