Article 26 de la Convention : L'envoi à la Commission d'un dossier de pièces n'interrompt pas à lui seul le cours du délai de six mois. Encore faut-il que les griefs auxquels se rapportent ces documents soient soulevés expressément ou implicitement dans les six mois suivant la décision interrie définitive .

Summtvy of the fects
The applicant has already seized the Commission of rwo applications : one in connexion with the bankruptry of his enterprise and the other cortcerning criminal proceedings brought against him . He has tried to obtain from the German courts the reopening of certain civil proceedings relating to his bankruptcy but his request has been rejected for the expiry of the limitation period. Finally, a three-judge committee of the Federal Constitutional Court has rejected the constitutional appeal lodged by the applicant on 9 July 1 979. !t is on the latter facts that the applicant has seized the Commission of the present application .

THE LA W The Commission observes first of all that the documents relating to the court proceedings on which the applicant now wishes to rely have already been before it when it exantined application No . 8610/79 . They thus do not constitute "relevant new information" in relation to that case which could justify a reopening of the Commission's earlier proceedings under Article 27 (1) (b) of the Convention . Since the matter of which the applicant complains is, however, not essentially the same as the subject of his previous application No . 8610/79, it could nevertheless be examined as a separate casé if all other conditions of admissibility were fultilled . Now it must be observed that the applicant's new arguntents were raised by him with the required clarity for the first time in a letter of 14 February 198 1 . It is true that he had already previously ventilated the possibilities of lodging a new application in relation to his bankruptcy case, having regard to Article 27 (1) (b) of the Convention, but the substance of the new case did not enterge front the relevant correspondence before the above date . Since the tinal domestic decision, i .e . the decision of the Constitutional Court on the particular issue in question, had already been taken on 9 July 1979, that is more than six months earlier than this date, the applicant's attention was drawn to the fact that there might be a problem concerning the observance of Article 26 of the Convention . In reply he submitted that he had sent the relevant documents to the Commission already in connection with his above application No . 8610/79, on 28 March, 7 November and 13 December 1979 respectively . In his view these dates should be taken into account when determining the starting point of the six months period envisaged by Article 26 of the Convention . However, the Commission is of the opinion that the mere submission of certain documents which might be relevant for a claim under the Convention is not in itself sufficient for the purposes of Article 26 . The related complaint must be raised in express terms or at least implicitly as a claim before the Comntission within six months from the final domestic decision . This was not done by the present applicant who came back on the subject only one and a half years later . The Commission therefore finds that the application has been tiled out of time . It must accordingly be rejected under Article 27 (3) of the Convention, read in conjunction with Article 26 . For this reason the Commissio n

Résumé des faits Le requératrt a déjà saisi la Commission de deux requétes relatives ['une à(a faillite de son entreprise, l'autre à des poursuites pénales dirigées contre lui. /l a tenté d'obtenir des tribunaux allemands la réouverture de certaines procédures civiles liées à/a faillite mais ses demandes ont été rejetées pour cause de prescription . En dernier lieu, un comité de trois juges de la Cour caistitutionne!le fédérale a écané le 9 juillet 1979 un recours du requérant. C «est sur ces faits que le requérant a saisi la Commission de la présente requête .
(TRADUCTION) EN DROIT La Contmission remarque en premier lieu que les documents afférant à la procédure judiciaire sur lesquels le requérant désire à présent se fonder lui avaient déjà été soumis lorsqu'elle a examiné la requête n° 8610/79 . lls ne constituent donc pas les "faits nouveaux" qui justifieraient de rouvrir conformément à l'article 27, paragraphe 1 (b) de la Convention, la procédure précédemment close par la Commission . Cependant . la question dont se plaint le requérant n'étant pas essentiellement la même que celle qui a fait l'objet de sa précédente requête N° 8610/79, elle pourrait néanmoins être examinée comme une affaire distincte si les autres conditions de recevabilité étaient réunies . Il faut ensuite remarquer que c'est seulement par sa lettre du 14 février 1981 que le requérant a présenté ses nouveaux arguments avec la précision requise . Il avait certes laissé entendre auparavant qu'il pourrait, eu égard à l'article 27, par . 1(b) . introduire une nouvelle requête à propos de son affaire de faillite . mais l'objet de cette nouvelle requête n'est pas apparu dans la correspondance y afférente avant la date susdite . Or, la décision interne définitive, c'est-à-dire l'arrêt de la Cour constitutionnelle rendu sur ce point précis . remonte au 9 juillet 1979, soit plus de six mois avant cette date . Aussi l'attention du requérant a-t-elle été attirée sur le fait qu'il pourrait y avoir probléme concernant le respect de l'article 26 de la Convention . Il a répondu avoir déjà adressé les documents pertinents à la Commission à propos de s a - 202 -
requête N° 8610/79, les 28 mars, 7 novembre, 13 décembre 1979 respectivement . De son point de vue donc, il fallait tenir compte de ces dates pour déterminer le point de départ du délai de six mois visé à l'article 26 de la Convention . Cependant, la Commission estime que le simple fait de soumettre certains documents pouvant concerner un grief au regard de la Convention ne suftit pas en soi pour que les conditions de l'article 26 soient remplies . Le grief auquel se rapportent ces documents doit être formulé en termes exprès ou, du moins, être implicitement contenu dans une plainte adressée à la Commission dans les six mois suivant la décision interne définitive . Cela n'a pas été fait par le requérant, qui n'est revenu sur la question qu'un an et demi plus tard . La Commission estime en conséquence que la requête est tardive et qu'elle doit donc être rejetée conformément à l'article 27, par . 3, de la Convention, lu en liaison avec l'article 26 . Par ces motifs, la Commission DÉCLARE LA REQUETEIRRECEVABLE .
