THE FACTS
The applicant, a Gerntan citizen, born in 1960, living in Nuremberg, is represented by Mr Hoffmann, lawyer in Nuremberg .

She submits that on the evening of 5 March 1981 the showing in Nuremberg Youth Centre of a film about squatters and police action against them provoked a spontaneous reaction of about 100-200 young people who left the centre and demonstrated in the city . Later some of the demonstrators returned to the youth centre . As shop windows and cars had been damaged in connection with the demonstration the police surrounded the youth centre and arrested nearly all persons (some 140 youths) including the applicant, who were in it . although, as the applicant states, some had not participated in the demonstration . AIl arrested persons were brought before an investigating judge on 6 March 1981 . Five judges of the District Court (Amtsgericht) took over the function of investigating judge to deal with the matter . The applicant was brought before Judge M ., who allegedly had volunteered for this special task . The applicant refused to make statements . Judge M . issued a warrant of arrest according to which the applicant was suspected of having participated in violent activities of a crowd of people, threatening public security and damaging the properties of others (Landfriedensbruch), in that she and about 200 other co-accused marched through the streets in the night of 6 March causing heavy damage (several tens of thousands of DM) inter nfia to shop windows and cars . The suspicion was derived from the fact that the applicant's arrest took place in immediate connection with the events in question . It was further stated in the warrant of arrest that the applicant belonged to or sympathised with squatters and that in view of the punishment she had to expect there was danger of absconding and furthermore danger of collusion (Verdunklungsgefahr) . Allegedly Judge M . issued some 50 similar warrants of arrest on the dame day .
On 14 March 1981 . after 9 days' detention in a prison near Munich . the applicant, who had then decided no longer to refuse to make statements with regard to the charges laid against her, was heard again and subsequently released . An indictment has meanwhile been filed against her but the criminal proceedings pending before the Regional Court ( Landgericht) in NurembergFü rth are, according to the applicant, provisionally stayed .
COMPLAINT S The applicant considers that after her arrest she was not brought before the lawful judge . She refers to Section 21e of the Judiciary Act (GVG) according to which the investigating judge of a court is nominated by the presidential board (Pr3sidium) in connection with the establishment of the general plan for the distribution of business (Geschaftverteilungsplan) . The presidential board is elected by all judges of a court . She further refers to the Nuremberg District Court's general plan for the distribution of business dated 10 December 1980 . It provides inter alia, under point 7, that duty judges who have to deal with urgent matters during off-duty hours or days are nominate d

separately . Allegedly the Nuremberg District Court's presidential board has, by decisions of 18 November 1980 and 23 February 1981, named for the period January-March 1981 and April-June 1981, in fixed order, those judges who have to assume duty-judge functions . Until 6 March 1981 the general plan for the distribution of business did not, however, contain any regulation for the case that more than one judge was needed at off-duty times . In view of the large number of arrested persons who had to be brought before an investigating judge the District court's presidential board held an extraordinary meeting on 6 March 1981 and decided to amend the plan for the distribution of business as follows : in case of the nominated duty judge being prevented by the amount of work or otherwise from disposing of urgent matters, the followingjudge listed in the order of duty-judges assumes functions . The applicant alleges that judge M . was nominated duty-judge by the court's President in violation of this regulation because he is not mentioned in the list of judges who were nominated duty judges for the periods JanuaryMarch and April-June 1981 respectively . The applicant's constitutional appeal was rejected on 16 October 1981 by three judges of the Federal Constitutional court as offering no prospects of success . With regard to the present complaint it is stated in the decision that the nomination of Judge M . as duty judge was justified under Section 21 i(2) of the Judiciary Act• . Undisputedly there was a necessity to nominate a further investigating judge . Undisputedly, the list of duty-judges for the period January-March 1981 had been exhausted . It had not been possible to arrange another meeting of the presidential board in order to decide a general and more far-reaching regulation with regard to the substitution of duty judges . In these circumstances, it was according to Section 21 i (2) of the Judiciary Act in the President's discretion to nominate a duty judge . His decision had to be guided by material grounds only . Such grounds were given in view of the advanced hour and the large number of arrested persons who still had to be brought before an investigating judge . There was nothing to show that the nomination of Judge M . as investigating judge was in any way arbitrary . The applicant's argument that there was no necessity for the President to nominate Judge M . as investigating judge because the next duty-judge in line was determined by the duty-judge list and order for April-June 1981 was refuted on the ground that this list related to another period and could not have determined the competence of a judge in the month of March . The presidential board's decision of 6 March 1981 regulating the problem of the competent duty-judge being prevented from assuming this task clearly referred to the duty judge list in operation, namely the list for January-March 1981 . • The provision reads : If a decision cannot be obtained on time by the presidential board the measurés designated in Section 21 e can be taken by the President or Ihe supe ri ntending judge .

The applicant contests the last mentioned reasoning and argues that according to the presidential board's decision of 6 March 1981 the duty-judge list of Aprit-lune 1981 had to be taken into account in order to determine which judges had been competent on 6 March 1981 to take over the function of investigating judge . She alleges that two judges who would have been contpetent according to that list were available on the afternoon of 6 March 1981 . l'he applicant i nvokes Articles 5(1) ( c) and 6(1) of the Conventio n
THE LA W The applicant has complained that Judge M ., who heard her after her arrest and ordered her detention on remand was in view of the District Court's general scheme for the distribution of business allegedly not competent to act as investigating judge on ihe afternoon of 6 March 1981 . She has argued that her arrest and detention violated Article 5(I) of ttte Convention as it was not justified under sub-paragraph (c) of this provision . Furtherntore she has alleged a violation of the right to an impartial tribunal established by law as guaranteed by Article 6( I) of the Convention . As regards the alleged violation of Article 6 (1) the Commission points out that this provision guarantees in general the right to a fair trial and the question whether a trial conforms to the standards laid down in Article 6 (1) must be decided on the basis of an evaluation of the trial as a whole and not on the basis of an isolated consideration of one particular incident which occurred in the course of the court proceedings in question (decision on the admissibility of Application No . 5574/72 . Decisions and Repor(s 3, p . 10, 16) . In the applicant's case the criminal proceedings are still pending . The Comniission therefore considers that the particular complaint raised in this application can only be examined under Article 5 which specifically relates to the question of the lawfulness of arrest and detention . Under Article 5 (1) (c) arrest and detention on rentand are justified if they are ordered in accordance with a procedure prescribed by law and effected for the purpose of bringing a person before the competent legal authority on reasonable suspicion of having committed an offence . The applicant has not argued in her submissions to the Commission that there existed no such objectively justifiable suspicion . She only complains that she was not brought before the "lawful judgé" after her arrest . However, sub-paragraph (c) only requires that the arrest be effected for the purpose of bringing a person before ttte "competent legal authority" while paragraph (3) of Article 5 specifies that every person arrested in accordance with paragraph (1)(c) shall be brought promptly before a"judgé' . The object of the latter provision is to afford to individuals deprived of their liberty a special guarantee : recourse not to a specific institution . namely a court, but so to a procedure of a judicia l

nature designed to ensure that no one is arbitrari ly dispossessed of his liber ty (Schiesser Case . Judgment of 4 December 1979, Series A . Vol . 34 . p . 14, paragraph 30) . It is not contested that the applicant was brought before a judge and the procedure followed was therefore undoubtedly of a judicial nature . The impartiality and objectivity of the judge cannot be put in question solely by the alleged fact that he volunteered for the work on the afternoon of 6 March 1981 . The requirements of Article 5 (3) have therefore been complied with in the applicant's case . It only remains to be determined whether or not the applicant was deprived of her libe rt y "in accordance with a procedure prescribed by law" (Article 5( 1), second sentence) . In this respect the Convention refers directly to the domestic law and to that extent disregard of the domestic law may entail a breach of the Convention . However, even assuming that the term "in accordance with a procedure presc ri bed by law" refers to statutory provisions regulating the organisation and working of a cou rt ( cf . Decisions on the admissibility of Applications Nos . 8692/79, Decisions and Reports 20, p . 209 and 9529/81, unpublished), it has first to be noted that as regards references by the Convention to domestic law, the scope of review by the Convention organs is limited and it is in the first place for the national authorities, notably the courts, to interpret and apply domestic law (Winterwerp Case, Judgment of 24 October 1979 . Series A, Vol . 33, p . 20, para . 46) . In the present case a group of threejudges of the Federal Constitutional Court has found that the nomination of Judge M . by the District Court's President to act as duty-judge on the afternoon of 6 March 1981 was effected in accordance with Section 21 i (2) of the Judiciary Act (GVG) . The provision in question autho rises the President of a Court to distri bute cases in urgent maters provided that the general scheme for the distribution of cases does not apply and that there is no time for the Court's presidential board to order a general scheme of dist ri bution applying to the particular situation . In the light of the applicant's submissions there are no sufficient reasons to conclude that the findings of the group of three judges of the Federal Constitutional Cou rt are incompatible with the Nureniberg District Court's situation on 6 March 1981 taking into account that Court's general regulations and orders existing on that date concerning the distribution of cases . The Commission also agrees with the finding in the decision of the group of three judges that there are no particular circumstances indicating that the nomination of Judge M . by the District Court's President to act as duty-judge ( investigating judge) was in any way arbitra ry . An examination by the Commission of this complaint as it has been submitted, including an examination made ex officio . does not therefore disclose any appearance of a violation of the rights and freedoms set out in the Convention and in particular in Article 5 of the Convention .

It tollows that the application is manifestly ill-founded within the meaning of Article 27 (2) of the Convention . For tttese reasons . the Commissio n DECLARES THIS APPLICATION INADMISSIBLE .
(TNADUCTIO M EN FAIT La requérante . citoyenne allemande née en 1960 vivant à Nuremberg . est représentée par M• Hoffmann . avocat dans cette ville . Elle soutient que, le soir du S mars 1981 . la projection, au Centre de la leunesse de Nuremberg . d'un film sur les squatters et les mesures prises par la police à leur encontre, a provoqué une réaction spontanée de quelque 100 à 200 Îeunes, qui ont quitté le centre pour manifester en ville . Plus tard, certains des manifestants . sont retournés au centre . Des vitrines et des voitures ayant été endommagées à l'occasion de la ntanifestation . la police a cerné le centre et arrêté presque toutes les personnes (environ 140 jeunes), y compris la requérante, qui s'y trouvaient, bien que, cotnnte l'affirnie la requérante, certaines n'aient pas participé à la manifestation . Toutes les personnes arrêtées ont été traduites devant un juge d'instruction le 6 mars 1981 . Cinq juges du tribunal cantonal (Amtsgericht) ont fait office de juges d'instruction pour traiter cette affaire . La requérante a été traduite devant le juge M ., qui se serait porté volontaire pour cette tâche particulière . La requérante a refusé de faire des déclarations . Le juge M . a délivré un mandat d'arrêt selon lequel la requérante était soupçonnée d'avoir participé à des violences commises par un attroupement menaçant la sécurité publique et endommageant les biens d'autrui (Landfriedensbruch), car ellentême et quelque 200 autres co-inculpés avaient défilé dans les rues la nuit du 6 mars, occasionnant des dégâts importants (de l'ordre de plusieurs dizaines de milliers de DM), notamment à des vitrines et des voitures . Les soupçons découlaient du fait que l'arrestation de la requérante avait eu lieu en relation immédiate avec les événements en question . Le mandat d'arrêt indiquait encore que la requérante faisait partie des squatters, ou était une sympathisante de ceux-ci, et qu'étant donné les sanctions auxquelles elle devait s'attendre, il y avait un risque de fuite ainsi que de collusion (Verdunkelungsgefahr) . Le juge M . aurait délivré le même jour quelque SO mandats d'arrêt analogues .

Le 14 mars 1981, après neuf jours de détention dans un établissement pénitentiaire situé près de Munich, la requérante, qui avait alors décidé de ne plus refuser de faire de déclarations concernant les charges pesant contre elle, a fait l'objet d'une nouvelle audition puis a été rel5chée . Elle a, depuis lors, été inculpée, mais l'action pénale en cours devant le tribunal régional (Landesgericht) de Nuremberg-Filrth est, selon la requérante, provisoirement suspendue .
GRIEFS La requérante estime qu'après son arrestation elle n'a pas été traduite devant le juge prévu par la loi . Elle renvoie à l'article 2le de la loi sur l'organisation judiciaire (GVG) selon laquelle le juge d'instruction d'un tribunal est nommé par le bureau (Prtisidium) dans le cadre de l'établissement du plan général de répartition des affaires (GeschBftsverteilungsplan) . Le bureau est élu par l'ensemble des magistrats du tribunal . Elle renvoie en outre au plan général de répartition des affaires du tribunal cantonal de Nuremberg, en date du 10 décembre 1980 . Celui-ci prévoir notamment, au point 7, que les ntagistrats de permanence qui doivent traiter des affaires urgentes pendant leurs heures ou leurs jours de liberté sont nommés individuellement . Le bureau du tribunal cantonal de Nuremberg aurail, par des décisions du 18 novembre 1980 et du 23 février 1981, nontmé pour les périodes janvier-mars 1981 et avril-juin 1981, dans un ordre fixe, les juges devant assumer les fonctions de magistrats de perntanence . Toutefois, jusqu'au 6 mars 1981, le plan général de répartition des affaires ne contenait aucune disposition pour le cas où plus d'un juge serait nécessaire en dehors des heures de service .
Compte tenu du grand nontbre de personnes arrêtées à traduire devant un juge d'instruction, le bureau du tribunal cantonal a tenu, le 6 mars 1981, une réunion extraordinaire au cours de laquelle il a décidé de modifier de la manière suivante le plan de répartition des affaires : lorsque le juge désigné pour assurer la permanence est empéché, par le volume de travail ou pour une autre raison, de régler les affaires urgentes, c'est le juge qui le suit sur la liste qui le remplace . La requérante soutient que le juge M . a été nommé juge de permanence par le président du tribunal en violation de cette règle, car il ne figure pas sur la liste des juges désignés pour assurer la permanence pendant les périodes janvier-mars et avril-juin 1981 . Trois juges de la Cour constitutionnelle fédérale ont rejeté, le 16 octobre 1981, le recours constitutionnel de la requérante, au motif qu'il n'avait aucune chance d'aboutir . S'agissant du présent grief, la décision déclare que la désignation du juge M . comme juge de permanence était justifiée aux terme s

de l'article 21 i(2) de la loi sur l'organisation judiciaire* . Incontestablement . il était nécessaire de nommer un juge d'instruction supplémentaire . Incontestablement, la liste des juges de permanence pour la période janvier-mars 1981 avait été épuisée . Il n'avait pas été possible d'organiser une autre réunion du bureau pour mettre au point une règle générale et de plus grande portée concernant le remplacement des juges de permanence . Dans ces conditions, le président avait toute discrelion, aux termes de l'article 21i(2) de la loi sur l'organisation judiciaire, pour nommer un juge de permanence . Sa décision ne pouvait reposer que sur des motifs concrets . Or il en existait bien, compte tenu de l'heure avancée et du grand nombre de personnes arrêtées qu'il fallait encore traduire devant un juge d'instruction . Rien ne ntontrait que la désignation du juge M . comme juge d'instruction eût été le ntoins du monde arbitraire . Le moyen de la requérante selon lequel le président n'était pas dans l'obligation de désigner le juge M . comme juge d'instruction, car le juge de permanence suivant était détertniné par la liste et l'ordre des juges de permanence pour avril-juin 1981, a été rejeté au motif que cette liste concernait une autre période et qu'elle n'aurait pas pu déterminer la compétence d'un juge au mois de niars . 11 ne fait aucun doute que la décision prise le 6 mars 1981 par le bureau pour régler le problème des juges compétents pour assurer la permanence ntais empêchés de remplir leur tâche visait la liste des juges de permanence qui était en vigueur, à savoir celle de janvier-mars 1981 .
La requérante conteste ce dernier raisonnement et soutient que, selon la décision prise par le bureau le 6 mars 1981 . il fallait tenir compte de la liste des juges de permanence en avril-juin 1981 afin de savoir quels juges étaient compétents le 6 mars 1981 pour assumer les fonctions de juges d'instruction . Elle prétend que deux juges qui auraient été compétents selon cette liste étaient disponibles l'après-midi du 6 mars 1981 . La requérante invoque les articles 5 paragraphe 1(c) et 6 paragraphe 1 de la Convention . EN DROI T La requérante se plaint que le juge M . . devant qui elle a comparu après son arrestation et qui a ordonné sa mise en détention provisoire, n'était pas contpétent pour exercer les fonctions de juge d'instruction l'après-midi du 6 mars 1981 . compte tenu du plan général de répartition des affaires du tribunal cantonal . Elle a soutenu que son arrestation et sa détention constituaient une violation de l'article 5, paragraphe 1, de la Convention, car elles n'étaient pas justifiées au titre de l'alinéa (c) de cette disposition . plainte, en outre, d'une violation du droit à comparaître devant un tribunal impartial établi par la loi, droit garanti par l'article 6 . paragraphe 1 . de la Convention . S'agissant de la violation alléguée de l'article 6, paragraphe 1, la Commission fait observer que cette disposition garantit d'une manière générale l edroitàunpcèséqablets,tu iondavrupcèse conforme aux exigences de l'article 6, paragraphe 1, doit être tranchée sur la base d'une appréciation du procès dans son ensemble et non à partir de l'examen séparé d'un incident déterminé intervenu au cours de la procédure en question (décision sur la recevabilité de la requête N° 5574/72, Décisions et Rapports 3, p . 10, 23) . Dans le cas de la requérante . l'instance pénale est en cours . La Commission estime donc que le grief particulier invoqué dans cette requête ne peut être examiné qu'au titre de l'article 5 . qui vise expressément la question de la légalité de l'arrestation et de la détention . Aux termes de l'article 5, paragraphe 1(c) . l'arrestation et la détention provisoire sont justifiées si elles sont ordonnées conformément à une procédure prévue par la loi et effectuées en vue de conduire une personne devant l'autorité judiciaire compétente lorsqu'il y a des raisons plausibles de soupçonner qu'elle a commis une infraction . La requérante n'a pas soutenu, dans ses exposés à la Commission, qu'il n'existait aucune raison plausible de la soupçonner . Elle se plaint seulement de n'avoir pas été traduite devant le .juge prévu par la loi ., après son arrestation . Toutefois, l'alinéa (c) exige seulement que l'arrestation soit effectuée en vue de conduire une personne devant - l'autorité judiciaire compétente=, tandis que le paragraphe 3 de l'article 5 précise que toute personne arrêtée dans les conditions prévues au paragraphe 1(c) doit être aussitôt traduite devant un •juge . . Cette dernière disposition a pour objet de donner une garantie spéciale aux individus privés de leur liberté : le recours non à une institution précise, à savoir un tribunal, mais à une procédure judiciaire, destinée à assurer que nul ne soit arbitrairement dépouillé de sa liberté (affaire Schiesser . arrêt du 4 décembre 1979 . Série A . colume 34, p . 13 . paragraphe 30) .
Il n'est pas contesté que la requérante a été traduite devant un juge aussi la procédure suivie était-elle certainenient judiciaire . On ne saurait ntettre en doute l'impartialité et l'objectivité du juge du seul fait qu'il se serait porté volontaire pour travailler l'après-midi du 6 mars 1981 . Les exigences de l'article 5, paragraphe 3, ont donc été respectées en l'espèce . Il reste seulement à déterminer si la requérante a été ou non privée de sa liberté . selon les voies légales . (article 5, paragraphe 1, deuxième phrase) . A cet égard, la Convention renvoie directement au droit interne, dont la méconnaissance pourrait entraîner ici une violation de la Convention . Toutefois, à supposer que l'expression • selon les voies légales . renvoie à des dispositions légales réglementant l'organisation et le fonctionnement d'un tribuna l -253-
(cf . décisions sur la recevabilité des requêtes Nos 8692/79, Décisions et Rapports 20 . p . 209 et 9529/81, non publiée), il convient tout d'abord de noter que, s'agissant des renvois faits par la Convention au droit interne, l'ampleur du conirôle que les organes de la Convention sont en mesure d'exercer est lintitée : il inconibe au premier chef aux autorités nationales, notamment aux tribunaux, d'interpréler et appliquer le droit interne (affaire Winterwerp, arrêt du 24 octobre 1979, Série A, volume 33 . p . 20, paragraphe 46) . En l'espèce, une chambre de trois juges de la Cour constitutionnelle fédérale a jugé que la désignation du juge M . . par le président du tribunal cantonal, comme juge de perntanence l'après-midi du 6 ntars 1981 avait été effectuée conformément à l'article 21 i(2) de la loi sur l'organisation judiciaire (GVG) . Cette disposition autorise le président du tribunal à répartir les affaires en cas d'urgence, à condition que le plan général de répartition des affaires ne s'applique pas et que le bureau du tribunal n'ait pas le temps de mettre au point un plan génér;d de répartition applicable à la situation en question . Les observations de la requérante ne laissent apparaitre aucun motif suffisant pour dire que les conclusions de la chambre de trois juges de la Cour constitutionnelle fédérale sont incompatibles avec la situation que connaissait le tribunal cantonal de Nuremberg le 6 mars 1981, eu égard aux règlentents et décisions de caractère général de ce tribunal en vigueur à cette date s'agissant de la répartition des affaires .
La Commission se rallie aussi à la conclusion des trois magistrats selon laquelle aucun élément particulier n'indique que la désignation du juge M ., par le président du tribunal cantonal, comme juge de permanence (juge d'instruction) ait été le moins du monde arbitraire . L'examen par la Commission de cette plainte telle qu'elle lui a été présentée, y contpris un exanten d'oPtice, ne révèle donc aucune violation des droits et libertés enoncés dans la Convention et notamntent à l'article 5 de celle-ci . Il s'ensuit que la requéle est manifestentent mal fondée, au sens de l'article 2 7, paragraphe 2, de la Convention . Par ces ntotifs, la Contmissio n DECLARE LA REOUETEIRRECEVABL E
