Summary of ehe facts
The applicant is a solicitor who represented the accused, A and B, at a crimina l trial before the Knightsbridge Crown Court . He instructed one counsel to represent both defendants and asked counsel's clerk to notify him of ihe hearing date . The barrister considered that the defendanis should be separately represented but the applicant, apparently as a result ofa misunderstanding, only applied for legal aid for one barrister. On 6 September 1983, the day of the trial, the barrister refused to appear alone and arranged for a colleague to request an adjournment . 7ire judge adjourned the hearing until the following day when the judge ordered the solicitor (the applicant) to pay the costs "rhrow•n away " . The applicant, who was appearing before another court was not able to attend.

In the absence of any appeal, the applicant tried in vain to nudce the judge reconsider his decision, in particular because he had not been able to address the judge himself.
THE LAW The applicant complains that he has been denied the opportunity of a fair hearing in conformiry with Article 6(I) of the Convention and in particular the opportunity for an appeal, in relation to the award of costs against him personally made by the judge of the Knightsbridge Crown Court as a result of the abortive hearing on 6 September 1983 . Anicle 6(1) provides, as far as material, as follows : "In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law . . . 11 The question arises in the present case whether this provision is applicable to the proceedings which resulted in the order that the applicant pay the costs of the hearing . The order was made in relation to the abortive appearance in criminal proceedings, relating to the trial of A and B, but that trial did not form part of the determination of a criminal charge against Lhe present applicant . The Commission recalls its decision on the admissibility of application No . 8249/78 (DR 20 p . 40) conceming disciplinary proceedings against a lawyer held in private for a minor misdemeanour, which resulted in a disciplinary sanction, namely a warning . In that case the Commission concluded, applying Lhe principles enounced by the Court in its decision of 8 June 1976 in the case of Engel and others (Series A volume 22 para 82), that the disciplinary proceedings in question did not involve the determination of a criminal charge . In the present case the applicant has contended that the judge in the Knightsbridge Crown Court was prosecutor in his own court in respect of a matter which he alone had determined to be a failing by the applicant, and that these aspects are such as to give the proceedings a criminal character . The Commission finds Ihat the nature of the order to pay costs made by the judge on 7 September 1983 involved an investigation of the applicant's conduct of proceedings, in the exercise of judicial control of the proper administration of justice, and particularly with a view to preventing avoidable delay in Lhe conduct of criminal proceedings . Furthermore it appears that the maximum penalty which could be imposed on the applicant by the judge in exercising this power was that which was imposed, namely that the applicant personally pay the costs "thrown away" in Lhe abortive appearance on 6 September 1983 . In these circumstances the Commission concludes that, although this involved the imposition of a sanction on Lhe applicant, the nature of the proceedings and the maximum possible penalty are not such as to result in the proper categorisation of these proceedings as the "determination of a criminal charge" within the meaning of Article 6(I) of the Convention .

The Commission must also consider whether these proceedings and the judge's order nevertheless involved the determination of the applicant's civil rights or obligations within the meaning of Article 6(1) of the Convention . In its decision on the admissibility of application No . 8249/78 (supra) the Commission referred to the decision of the Court in the Ktinig case (judgment of 28 June 1978, Series A Volume 27 paras 91-95) . In so doing the Commission recognised that, assuming that the right to practice as a lawyer could be classified as a civil right within the meaning of Article 6(1), that right was not the subject of the proceedings before the disciplinary organs of the Bar Association in the case referred to . In the present case the applicant has pointed out that the basis of an order that a solicitor bear the costs in the way in which the applicant was ordered to pay them depends in the first place upon an assessment by the trial judge that the solicitor in question has in fact been negligent . Furthermore this is the basis of the applicant's objection to the requirement that he pay the costs, which he considered wholly unreasonable in normal circumstances, since he disputes that he was negligent at all and points out that he was let down by counsel . The Commission recognises that in imposing the requirement that the applicant pay the costs "thrown away" on 6 September 1983 it was necessary for the judge to evaluate to some extent the applicant's conduct of the case which had resulted in the question of an adjournment . That this evaluation could only be partial and superficial is well-illustrated by the mere fact that the applicant was not present to explain matters to the Court, still less to defend his professional reputation . Nevertheless . the Commission concludes that the judge's investigation of this aspect of the applicant's conduct of proceedings was conducted, not in the context of an evaluation of his professional capabilities as such, or of his professional relationship with his client, but as an aspect of the proper administration ofjustice, responsibility of which ultimately lies with the judiciary . The Commission therefore concludes that the judge's order, and the exceptional proceedings, in the absence of the applicant and with scant prior notice to him, must properly be regarded as disciplinary proceedings in the context of the administration of justice and the proper organisation of the work of the courts, and hence did not involve a detertnination of the applicant's civil rights or obligations . It follows that the provisions of Article 6(I) of the Convention are not applicable to the proceedings in question, and that the applicant's complaints are incompatible ratione materiae with the provisions of the Convention and must therefore be declared inadmissible within the meaning of Article 27 (2) of the Convention . For these reasons, the Commission DECLARES THE APPLICATION INADMISSIBLE .

Résumé des faits le requérant, qui est solicitor, avait à représenter les intérêts de deux accusés, A. et B., dans un procès pénal pendant devant la Crown Coun de Knightsbridge . Il instruisit à cet effet un barrister chargé de défendre les deux accusés et demanda au clerc de ce demier de l'(nformer du jour du procès . Le barrister estima que chacun des accusés devait avoir son propre conseil mais le requérant, à la suite, semble-t-il, d'un malentendu, ne demanda l'assistance judiciaire que pour un barrister. Le 6 septembre 1 983, jour du procès, le barrister, refusant de se présenter seul, fit demander l'ajournement de l'audience par un confrère . Le juge ajourna l'audience au lendemain mais mit les frais de l'audience inutile du 6 septembre à la charge du solicitor (le requérant), qui ne put comparaftre luimême le lendemain, retenu par une autre audience . A défaut de toute voie de recours, le requérant tenta en vain de faire revenir le juge sur sa décision, en se plaignant notamment de n'avoir pu s'expliquer devant lui .
(TRADUCTION) EN DROIT Le requérant se plaint de s'être vu refuser la possibilité d'étre entendu équitablement, en conformité de l'anicle 6 par . 1 de la Convention, et en particulier de recourir contre sa condamnation par le juge de la Crown Court de Knightsbridge, à la suite de l'audience inutile du 6 septembre 1983 . Dans la mesure où il est pertinent, l'article 6 par . 1 stipule : «Toute personne a droit à ce que sa cause soit entendue équitablement, publiquement et dans un délai raisonnable, par un tribunal indépendant et impartial, établi par la loi, qui décidera soit des contestations sur ses droits et obligations de caractère civil, soit du bien-fondé de toute accusation en matiére pénale dirigée contre elle . » La question se pose ici de savoir si cette disposition s'applique à la procédure qui a abouti à la condamnation du requérant aux frais de l'audience . Cette condamnation suivait la comparution inutile dans une procédure pénale relative au procès de A . et B ., mais ce procès ne portait nullement sur l'examen d'une accusation pénal e

contre le requérant . La Commission rappelle sa décision sur la recevabilité de la requête No 8249/78 (D .R . 20 p . 40) relative à une procédure disciplinaire contre un avocat, qui s'était déroulée à huis clos, portait sur une faute mineure et avait abouti à la sanction disciplinaire de l'avertissement . Dans cette affaire, la Commission, appliquant les principes énoncés par la Cour dans son arrét du 8 juin 1976, relatif à l'affaire Engel et autres (Série A, volume 22, par . 82), a conclu que cette procédure disciplinaire n'impliquait pas une décision sur le bien-fondé d'une accusation pénale . Dans la présente affaire, le requérant prétend que le juge de la Crown Court de Knightsbridge s'est fait procureur dans son propre tribunal au sujet d'une question que lui seul a définie comme un manquement de la part du requérant, et que ces éléments sont de nature à donner à la procédure un caractére pénal . La Commission constate que la nature de la condamnation aux frais prononcée par le juge le 7 septembre 1983 impliquait une enquête sur la manière dont le requérant avait mené la cause, et cela dans l'exercice du contrôle judiciaire de la bonne administration de la justice, en particulier dans le but de prévenir des retards évitables dans la conduite d'une procédure pénale . 0 apparaît en outre que la pénalité maximale que le juge, dans l'exercice de ce pouvoir, pouvait imposer au requérant, est celle qui fut effectivement prononcée, c'est-à-dire la condamnation du requérant à supporter personnellement les frais superflus de la comparution inutile du 6 septembre 1983 . Dans ces conditions, la Commission conclut que, quand bien méme on se trouve en face d'une sanction infligée au requérant, le caractére de la procédure et la pénalité maximale possible ne sont pas tels qu'ils permettent de classer cette affaire parmi celles qui comportent une • décision sur le bien-fondé d'une accusation pénale » , au sens de l'article 6 par . I de la Convention . La Commission doit examiner encore si cette procédure et cette décision du juge emportaient cependant une décision sur des droits ou obligations de caractère civil du requérant, au sens de l'article 6 par . 1 de la Convention . Dans sa décision sur la recevabilité de la requête No 8249/78 (supra), la Commission se référait à l'arrét de la Cour dans l'affaire Kdnig (arrêt du 28 juin 1978, série A, volume 27, par . 91-95) . Ce faisant, elle reconnaissait que, à supposer que le droit d'exercer la profession d'avocat puisse être classé comme droit civil au sens de l'article 6 par . I, ce droit n'était pas l'objet de la procédure devant les organes disciplinaires de l'Ordre des avocats, dans l'affaire évoquée . Dans la présente affaire, le requérant a souligné que l'ordonnance condamnant, comme en l'espèce, un avocat aux frais se fonde avant tout sur une appréciation du juge du procés selon laquelle l'avocat en question a effectivement fait preuve de négligence . Or, c'est ici la base même de l'objection du requérant contre sa condamnation aux frais, qu'il considére comme tout à fait déraisonnable dans des circonstances normales car il conteste toute négligence de sa part, et souligne que son barrister lui a fait faux bond . La Commission admet qu'en condamnant le requérant aux frais superflus du 6 septembre 1983, le juge devait nécessairement apprécier dans une certaine mesure

la maniére dont le requérant avait mené la cause et qui avait abouti à un ajoumement . Que cette appréciation n'ait pût étre que partiale et superficielle est bien illustré par le fait que le requérant n'était pas présent pour s'expliquer devant le tribunal et encore moins pour défendre sa réputation professionnelle . La Commission estime toutefois que l'examen par le juge de cet aspect de conduite du requérant dans la procédure a été effectué non dans le cadre d'une appréciation de ses capacités professionnelles comme telles ou de ses rapports professionnels avec son client, mais comme faisant partie d'une bonne administration de la justice, dont le pouvoir judiciaire est en définitive responsable . La Commission conclut par conséquent que l'ordonnance du juge, et la procédure exceptionnelle, en l'absence du requérant et sur un bref préavis à ce demier, doit être considérée comme une mesure proprement disciplinaire dans le cadre de l'administration de la justice et de la bonne organisation du travail des tribunaux . Elle n'impliquait par conséquent aucune décision relative aux droits et obligations de caractére civil du requérant . Il s'ensuit que les dispositions de l'article 6 par . 1 de la Convention ne sont pas applicables à ladite procédure et que les griefs du requérant sont incompatibles ratione materiae avec les dispositions de la Convention . La requéte doit par conséquent ètre déclarée irtecevable, au sens de l'article 27 par . 2 de la Convention . Par ces motifs, la Conunission DÉCLARE LA REQUÉTE IRRECEVABLE .
