THE FACTS
The applicant is a German citizen living in B . He is a teacher at a professional training school of Lower Saxony and as such he is a permanent civil servant (Beamter) . The applicant is represented by H . Schulz-Koffka and others, a law firm in Hannover .
The applicant is a long-standing member of a teacher's union (Gewerkschaft Erziehung und Wissenschaft-GEW) and also a member of the Regional Managing Board (Landesvorstand) of this union . The union struggles inter alia for the reduction of the working hours for teachers . On 28 September 1979 a majority of the District Directors of the GEW in Lower Saxony decided to advise its members to go on a short strike in order to stir up public interest on the issue . Subsequently all members of the union were requested to state whether they were for or against the strike and a majority voted for a strike . Consequently GEW's Managing Board of Lower Saxony decided on 7 November 1979 by a secret ballot to call a strike of 2 hours for the classes on 13 November 1979 . The applicant took part in the vote . With one abstention, all participants voted for the strike . In reaction to the decision of 7 November 1979, the competent authorities (Bezirksregierung) in Hannover took disciplinary action against seven members of GEW's Managing Board . On 9 September 1980 a disciplinary order was given against the applicant, imposing a disciplinary sanction in the amount of DM 4,000 . The applicant's complaint (Beschwerde) against the disciplinary order was rejected by the Minister of Cultural Affairs of Lower Saxony on 10 February 1982 . The Ministry pointed out that according to Article 33(5) of the Federal Constitution (GG) and the constant case law of the Federal Constitutional Court, the Federal Administrative Court and the Federal Court civil servants were not allowed to go on strike or to take other action similar to a strike . Furthermore, the Ministry referred to decisions of disciplinary courts according to which a civil servant grossly violated his professional obligations if he advised or incited other civil servants to go on strike . As the applicant had participated in the meeting of GEW's Managing Board of 7 November 1979 and had neither alleged to have voted against a strike nor subsequently dissociated himself from the vote taken, he had violated his professional obligations although he had been warned beforehand that a strike and calling for a strike would be illegal . The applicant appealed to the Disciplinary Chamber of the Administrative Court in Hannover which dismissed his appeal on 24 August 1982 without an oral hearing . The court confirmed that civil servants were not allowed to go on strike and therefore GEW's Managing Board's decision of 7 November 1979 to call a strike was likewise unlawful . The applicant's responsibility was engaged because he participated in the vote of the Managing Board and this vote was alleged to have bee n

unanimous . In any event, the applicant had never dissociated himself from the decision taken on 7 November 1979 . The applicant's action was neither covered by the right to freedom of expression, nor by the trade union right as guaranteed by Article 5(I) and (2) and Article 9 (3) of the Constitution (GG) . These rights were limited insofar as the functioning of the civil service required restrictions in accordance with the rvle of law . The applicant was not fined because he simply participated in a trade union activity, but because this activity was incompatible with his duties as a civil servant . As the applicant had been warned by the authorities that the preparation of a strike was unlawful, he could not justify his action by the mere fact that his union considered the call for a strike to be lawful . The applicant then lodged a constitutional complaint which was rejected on 25 October 1982 by a group of three judges of the Federal Constitutional Court as offering no prospects of success . The decision confirms that civil servants are not allowed to go on strike and to that extent the right to freedom of expression and the trade union right are limited . Consequently, the disciplinary action taken against the applicant was compatible with his constitutional rights and there was nothing to show that the fine imposed on the applicant was in any way arbitrary . The applicant's right to be heard was not violated by the mere fact that the Disciplinary Chamber of the Administrative Court did not hold an oral hearing . He had the opportunity to submit his observations in writing . COMPLAINT S The applicant considers that his disciplinary sanction violates Articles 9, 10 and I I of the Convention and that the proceedings before the Administrative Court violate Article 6 para . I of the Convention because there was no oral hearing . He argues that in view of the importance of the fine imposed on him the proceedings concemed the determination of a criminal charge .
THE LAW 1 . The applicant complained that his appeal to the Disciplinary Chamber of the Administrative Court in Hannover was decided on the basis of the parties' written submissions without an oral hearing . He has invoked Article 6 para . I which provides to everyone a fair and public hearing in the determination of his civil rights or obligations or of any criminal charge against him . However disciplinary proceedings against a civil servant, relating to the conduct of the civil servant in his official function are not concerned with the determination of civll rights and obligations (see N° 734/60, Collection 6, 29 ; N° 8496/79, Dec . 8 .10 .80, D .R . 21 p . 168 and N° 8686/79, Dec .8 .10 .80, D .R . 21 p . 208) .

Furthermore the charge against the applicant was exclusively of a disciplinary nature and the punishment, not involving deprivation of liberty, is not in the circumstances of the present case a penalty belonging to the criminal sphere (cf . (he two last cited decisions relating to dismissal from service) . It follows that the proceedings in question did neither determine a civil right or obligation nor a criminal charge and the guarantees provided for in Article 6 do not apply to them . Consequen(ly the present complaint is incompatible rarione rnnteriae with the provisions of the Convention, within the meaning of Article 27 para . 2 . 2 . The applicant further argued that his disciplinary penalty amounts to a violation of the rights guaranteed by Articles 9 to I I of the Convention . The Commission mainly considered his complaint under Article II para . I which guarantees to everyone the right to join trade unions for the protection of his interests . However the applicant's disciplinary punishment was not based on the fact that the applicant is a member of a trade union . He was punished because as a leading member of a trade union he participated in a decision of his trade union advising the members of the union, namely teachers, to participate in a strike although under German law civil servants (Beamte) are not allowed to strike . In this regard, the Commission recalls that the European Court of Human Rights, in its judgments in the National Union of Belgian Police Case (judgment of 27 October 1975, Series A no . 19, para . 39) and the Swedish Engine Drivers' Union Case (judgment of 6 Febntary 1976, Series A no . 20, para . 40) dealt with the scope of the protection afforded by Article I 1 para . I of the Convention . The Court pointed out that members of a trade union have a right, in order to protect their interests, that the trade union should be heard but added that Article 1 I para . I certainly leaves each State a free choice of the means to be used towards this end . The Court concluded that what the Convention requires is that under national law trade unions should be enabled, in conditions not at variance with Article 11, to strike for the protection of their members' interests . In the Schmidt and Dahlstr&m Case, the Court dealt more specifically with the right to strike (Eur . Court H .R ., judgment of 6 February 1976, Series A no . 21, para . 36) . On this point the Court expressed itself as follows : "The Court recalls that the Convention safeguards freedom to protect the occupational interests of trade union members by trade union action, the conduct and development of which the Contracting States must both permit and make possible (National Union of Belgian Police judgment, 27 October 1975, Series A no . 19, p . 18, para . 39) . Article 1 I para . I nevertheless leaves each State a free choice of the means to be used towards this end . The grant of a right to strike represents without any doubt one of the most important of these means, but there are others . Such a right, which is not expressly enshrined in Article 11 . may be subject under national law to regulation of a kind that limits its exercise in certain instances . The Social Charter of 18 October 1961 only

guarantees the right to strike subject to such regulation, as well as to "further restrictions" compatible with its Article 31, while at the same time recognising for employers too the right to resort to collective action (Article 6 para . 4 and Appendix) . For its part, the 1950 Convention requires that under national law trade unionists should be enabled, in conditions not at variance with Article 11, to strive through the medium of their organisations for the protection of their occupational interests . " It follows from this statement that, while the right to strike may be a very imponant element in the exercise of the right to freedom of association, the latter right can also be respected through other means . The Commission notes that, while Crerman law recognises the right to strike, it does not grant this right to civil servants in view of their special legal status . Consequently, it is not necessary in the present case to examine the question as to whether a more general failure by a State to recognise the right to strike could be consistent with the right guaranteed under Anicle I I para . 1 . Having regard to the Court's interpretation of the right guaranteed by Article 11 para . 1, the Commission is of the opinion that the disciplinary action taken against the applicant for having participated in a decision advising a strike or a strikelike action cannot in itself be regarded as a violation of the applicant's right to freedom of association . The applicant has not adduced any additional elements indicating that his right under Article II para . I has been restricted . Furthermore the Commission considers that there is no violation of Articles 9 or 10, since the applicant was not punished for holding or expressing an opinion or belief but for participating in an action destined to provoke a strike in public civil service . This part of the application has, therefore, to be rejected as being manifestly ill-founded within the meaning of Article 27 para . 2 of the Convention . For these reasons, the Commissio n DECLARES THE APPLICATION INADMISSIBLE .

(TRADUCTION) EN FAI T Le requérant est un ressortissant allemand habitant B . Il enseigne dans une école professionnelle de Basse-Saxe et est en cette qualité fonctionnaire titulaire (Beantter) . Le requérant est représenté par le cabinet H . Schulz-Koffka et Cie, avocats à Hanovre . Le requérant est depuis longtemps affilié à un syndicat d'enseignants (Gewerkschaft E rz iehung and Wissenschaft-GEW) . B est aussi membre du bureau directeur régional ( Landesvorstand) de ce syndicat, qui lu tt e notamment pour la réduction des heures de travail des enseignants . Le 28 septembre 1979, une majorité des secrétaire de district du GEW en Basse-Saxe décida de conseiller à ses adhérents de faire une cou rt e grève pour att irer l'attention du public sur cette question . Par la suite, tous les adhérents au syndicat furent priés de déclarer s'ils étaient pour ou contre la grève et une majorité se prononça en faveur de ce tte action . En conséquence, le bureau directeur du GEW de Basse-Saxe décida le 7 novembre 1979, au scrutin secret, d'appeler à une grève de deux heures pour les classes du 13 novembre 1979 . Le requérant prit part au vote . A l'exception d'une abstention, tous les participants se prononcèrent pour la grève . En réaction à la décision du 7 novembre 1979, les autorités compétentes (Bezirksregierung) de Hanovre engagèrent une procédure disciplinaire contre sept membres du bureau directeur du GEW . Le 9 septembre 1980, une décision disciplinaire fut prononcée à l'encontre du requérant, lui inFligeant une amende disciplinaire de 4 .000 DM . Le recours (Beschwerde) formé par l'intéressé contre ce tt e décision disciplinaire fut rejeté le 10 fév ri er 1982 par le ntinistre des affaires culturelles de Basse-Saxe . Le ministre sou)igna qu'aux termes de l'article 33 par . 5 de la Loi fondamentale ( Constitution) fédérale (GG) et selon la ju ri sprudence constante de la Cour constitutionnelle, de la Cour administrative fédérale et de la Cour supréme fédérale, les fonctionnaires ne sont pas autorisés à faire grève ni à se livrer à d'autres actions analogues à une grève . Le ntinist8re se référait en outre aux décisions des tribunaux disciplinaires selon lesquelles un fonctionnaire manque gravement à ses obligations professionnelles s'il conseille ou incite d'autres fonctionnaires à faire grève . Or, le requérant ayant participé à la réunion du bureau directeur du GEW le 7 novembre 1979 et n'ayant pas allégué avoir voté contre la grève ni s'être par la suite désolidarisé du vote, il avait manqué à ses devoirs professionnels, bien qu'il e0t été averti au préalable qu'il serait illégal de faire gr8ve ou d'inciter à la grève . Le requérant recourut devant la chambre disciplinaire du tribunal administratif de Hanovre, qui le débouta le 24 août 1982 sans audience contradictoire . Le t ribunal confirma que les fonctionnaires ne sont pas autori sés à faire grève et que, dès lors, la décision prise le 7 novembre 1979 par le bureau directeur du GEW d'appeler à - 242 -
une grève était illégale . La responsabilité du requérant se Irouvait engagée puisqu'il avait participé au vote du bureau directeur et que ce vote aurait été pris à l'unanimité . Au demeurant, le requérant ne s'était jamais désolidarisé de la décision du 7 novembre 1979 . Les actes du requérant ne relevaient ni du droit à la liberté d'expression ni du droit syndical, tels que les garantissent l'article 5 par . 1 et 2 et l'article 9 par . 3 de la Loi fondamentale (GG) . Ces droits se trouvent frappés des restrictions nécessaires à la bonne marche de la fonction publique et conformes au principe de la prééminence du droit . L'amende n'avait pas été infligée au requérant simplement parce qu'il avait pris part à une activité de son syndicat mais parce que cette activité était incompatible avec ses obligations de fonctionnaire . L'intéressé ayant été averti par les autorités que la préparation d'une grève était illégale, il ne pouvait pas justifier ses actes par le simple fait que son syndicat considérait comme légal l'appel à la grève . Le requérant introduisit alors un recours constitutionnel, qu'un comité de trois juges de la Cour constitutionnelle fédérale rejeta le 25 octobre 1982 comme dépourvu de chances de succès . Cette décision confirmait que les fonctionnaires ne sont pas auto risés à faire gréve, ce qui limite d'autant le droit à la libert é d'expression et le droit syndical . La procédure disciplinaire engagée cont re le requérant était donc compatible avec les droits que lui reconnaît la Loi fondamentale et rien ne montrait que l'amende infligée fût aucunement arbitraire . Le droit du requérant à ètre entendu n'avait pas été méconnu du simple fait que la chambre disciplinaire du tribunal administratif n'avait pas tenu d'une audience contradictoire, l'intéressé ayant eu la possibilité de soumettre ses obse rv ations par éc ri t . GRIEFS Le requérant estime que la sanction disciplinaire qui lui a été infligée viole les anicles 9, 10 et 11 de la Convention et que la procédure devant le t ribunal administratif est contraire à l'article 6 par . 1 de la Convention du fait de l'absence d'audience contradictoire . Il soutient que vu l'importance de l'amende qui lui a été infligée, la procédure comportait une décision sur une accusation pénale .
EN DROI T I . Le requérant s'est plaint de ce que la chambre disciplinaire du tribunal administratif de Hanovre a statué sur la base des observations écrites des pa rt ies sans tenir d'audience contradictoire . Il a invoqué l'article 6 par . I, qui stipule que toute personne a droit à ce que sa cause soit entendue équitablement et publiquement par un tribunal qui décidera, soit des contestations sur ses droits et obligations de caractére civil, soit du bienfondé de toute accusation en matière pénale dirigée contre elle . Cependant, une procédure disciplinaire engagée contre un fonctionnaire à propos de sa conduite dan s

ses fonctions officielles n'emporte pas décision sur des droits et obligations de caractère civil (cf . Décisions sur les requêtes No 734/60, Rec . 6 p . 29 ; No 8496/79, déc . 8 .10 .80 . D .R . 21 p . 168 et No 8686/79, déc . 8 .10 .80, D .R . 21 p . 208) . En outre, l'accusation portée contre le requérant avait un caractère exclusivement disciplinaire et, dans les circonstances de l'espèce . la sanction, non privative de liberté, n'était pas une peine ressortissant au domaine pénal (cf . les deux décisions citées plus haut concernant un licenciement de la fonction publique) . Il s'ensuit que la procédure en question n'emportait décision ni sur un droit ou une obligation de caractère civil ni sur une accusation pénale et que, d8s lors, les garanties énoncées à l'article 6 ne lui étaient pas applicables . En conséquence, le présent grief est incompatible ratione utateriae avec les dispositions de la Convention au sens de l'article 27 par . 2 . 2 . Le requérant a soutenu en outre que la sanction disciplinaire qui lui a été infligée conslitue une violation des droits que lui garantissent les articles 9 à 11 de la Convention . La Commission a examiné essentiellement ce grief au regard de l'article 11 par . I, qui garantit à toute personne le droit de s'affdier à un syndicat pour la défense de ses intéréts . Cependant, la sanction disciplinaire infligée au requérant ne se fondait pas sur son affiliation syndicale . L'intéressé a été sanctionné parce qu'en tant que membre dirigeant d'un syndicat, il avait pris part à une décision de ce syndicat conseillant aux adhérents, à savoir des enseignants, de prendre part à une grève, alors qu'en droit allemand les fonctionnaires (Beamten) ne sont pas aulorisés à faire grève . A cet égard, la Commission rappelle que, dans les arrêts qu'elle a rendus dans l'affaire du Syndicat National de la Police belge (arrèt du 25 octobre 1975, par . 39) et dans l'affaire du Syndicat suédois des conducteurs de locomotive (arrêt du 6 février 1976, par . 40), la Cour européenne des Droits de l'Homme a traité de l'étendue de la protection offerte par l'anicle 11 par . I de la Convention . Elle a souligné qu'en vue de la défense de leurs intérèts, les membres d'un syndicat ont droit à ce que celui-ci soit entendu, mais elle a ajouté qu'assurément l'article 11 par . I laisse à chaque Etat le choix des moyens à employer à cette fin . La Cour a conclu que ce qu'exige la Convention, c'est que la législation nationale permene aux syndicats, selon des modalités non contraires à l'article 11, de lutter pour la défense des intéréls de leurs membres . Dans l'affaire Schmidt et Dahlstrüm . la Cour a traité particuliérement du droit de grève (arrét du 6 février 1976, par . 36) . A cet égard . la Cour s'est exprimée en ces termes : « La Cour rappelle que la Convention protège la liberté de défendre les intér@ts professionnels des adhérents d'un syndicat par l'action collective de celui-ci, action dont les Etats contractants doivent à la fois autoriser et rendre possible la conduite et le développement (arrét Syndicat National de la Police belge, d u -244-

En conséquence, il n'est pas nécessaire en l'espèce d'examiner si le fait pour un Etat de ne pas reconnaître, en général, le droit de grève serait compatible avec le droit protégé par l'anicle 11 par . 1 . Vu l'interprétation donnée par la Cour du droit protégé par l'article 11 par . 1, la Commission estime que la mesure disciplinaire décidée contre le requérant poûr participation à une décision conseillantune grève ou une action revendicative analogue ne saurait en soi étre considérée comme une violation du droit du requérant à la liberté d'association . L'intéressé n'a par ailleurs soumis aucun élément complémentaire prouvant que le droit que lui garantit l'article 11 par . 1 aurait été restreint .
