Article 5, pursgraphe 2, de la Convention : S'agissant d'une arrestation en vue d'extradition, les informations données à l'intéressé n'ont pas à être aussi complétes que lors d'une arrestation en vue d'être jugé, dans le cas prévu à l'anicle 5 par . 1 litt . c) .
Summary of the relevant facts

7he applicant (•) was arrested in October 1983 by the Belgian police whilst on Belgian territory forming an enclave within the Netherlands . Or the same day, on being taken into custody in Belgium, he was served with an arrest warrant for his extradition to the United States of America in order to face charges of fraud set out in a "radiogram of 22 August 1983, the reference being 22/2219"'. According to the applicant, the radiogram was not joined to the warrant . 7i'e applicant contested the legality of his arrest, but the court at Turnhout found that the arrest had been lawfully ordered on the basis of a request for extradition and that details of the request were in the file . (•) The applicani was represented hefore rhe fommission by Mr . A Oomen, a lawyer prenlsing in The Hague .

On the applicant's appeal, the Antwerp Court of Appeal confinned the decision at first instance, finding in panicu(ar rhat the "radiogram of 22 August 1983, the reference being '222219"' had in fact been attached to the arrest warrant . A plea of nullity to rhe Court of cassation was subsequently rejected .
THE LAW (Extract )
The applicant ( fu rt her) complains that he has never been properly informed of the reasons for his arrest contrary to An . 5 (2) of the Convention . Art . 5 (2) of the Convention provides that "everyone who is arrested shall be informed promptly in a language which he understands of the reasons for his arrest and of any charge against him" . The Commission has previously held that A rt . 5 (2) does not require that a complete description of all the charges should be given to the accused at the moment of the arrest (cf. Application No . 4220/69, X . v . United Kingdom, Yearbook 14, p . 250 . 278) . The above reasoning applies mutatis murandis to the arrest of persons with a view to their extradition, the meaning A rt . 5 (2) being that a person should know why he is arrested by the police . While it is true that insufficiency of information of the charges held against an arrested person may be relevant for the ri ght to a fair trial under Art . 6 of the Convention for persons arrested in accordance with Art . 5 (I) (c), the same does not apply to the arrest with a view to extradition as these proceedings are not concerned with the determination of a criminal charge . It appears from the warrant of arrest of I I October 1983 that the applicant was suspected of fraud, arnd that his arrest was being ordered for the purposes of extradition to the United States . The Commission finds that the above elements constituted sufficient information concerning the reasons for his arrest and the charge held against him for the purposes of An . 5 (2) . It follows that this complaint is also manifestly ill-founded within the meaning of Art . 27 (2) of the Convention .

Résumé des faits pertinents Le requérant (•) a été arrêté en octobre 1983 par la police belge sur un territoire belge constituant une enclave à l'intérieur des Pays-Bas . Le méme jour, au moment d'étre écroué en Belgique, il lui fut présenté un mandat d'arrét en vue de son estradition aux Etats-Unis pour y répondre d'infractions d'escroquerie à raison de faits relatés dans un .radiogramme référence 22/2219 du 22 aoGt 1983- . Le requérant soutient que ce radiogramme n'était pas joint au mandat .
Le requérant ayant contesté la léga(ité de sa mise en détention, le tribunal de Tumhout constata que celle-ci avait été régulièrement ordonnée en raison d'une dernande d'extradition, dont les détails figuraient au dossier. Sur appel du requérant, la cour d'appel d'Anvers confirma le 8 décembre /983 la décision'du premier juge, après avoir constaté en particulier que le « radiogramme référence 22/22/9 du 22 aoGt 1983- était bien annexé au mandat d'arrêt . Un pourvoi en cassation du requérant fut rejeté ultérieurement .
(TRADUCTION) EN DROIT ( Extrait )
Le requérant se plaint (en outre) de n'avoir jamais été convenablement informé des raisons de son arrestation, contrairement à l'article 5 oar . 2 de la Convention . L'article 5 par . 2 stipule que • toute personne arrétée doit être informée, dans le plus court délai et dans une langue qu'elle comprend, des raisons de son arrestation et de toute accusation portée contre elle» . La Commission a déjà antérieurement considéré que l'article 5 oar . 2 n'exige pas qu'une énumération complète de toutes les accusations soit donnée à l'accusé au moment de son arrestation (No 4220/69, X . c/Royaume-Uni, Annuaire 14 pp . 250 . 278) . Le raisonnement ci-dessus s'applique mutatis mutandis à l'arrestation de personnes en vue de leur extradition, le sens de l'anicle 5 par . 2 étant qu'un (') Le requérani éuit reprfsenié devani la Conimission par Me A . individu doit savoir pourquoi la police l'arrête . S'il est vrai qu'une information insuffisante quant aux charges qui pèsent sur une personne arrétée peut influer sur le droit à un procès équitable, énoncé à l'anicle 6 de la Convention, pour les personnes arrêtées dans les circonstances de l'article 5 par . 1 c), on ne peut en dire autant de l'arrestation en vue d'extradition car il s'agit alors d'une procédure n'appelant pas une décision sur le bien-fondé d'une accusation . Il appert, au vu du mandat d'arrèt du 11 octobre 1983, que le requérant était soupçonné d'escroquerie et que son arrestation avait été ordonnée en vue de son extradition aux Etats-Unis . La Commission estime que les éléments précités constituent une information suffisante quant aux raisons de l'arrestation et aux charges pesant sur l'intéressé, aux fins de l'a rt icle 5 par . 2 . 11 s'ensuit que ce grief est (lui aussi) manifestement mal fondé, au sens de l'article 27 par . 2 de la Convention . . . . . .. . .. . . . . .
