The applicant is a German citizen bom in 1930 who lives at W . He is represented by Mr . Klaus Sojka, a lawyer practising in Hamburg . The applicant enjoys shooting rights (as "Jagdptichter") in a hunting district situated in the area for which the local government (Bezirksregierung) of Koblenz on 20 February 1978 issued a general police order (Viehseuchenpolizeiliche Anordnung) for protection against rabies requiring the gassing of all fox-holes (Begasung aller Fuchsbaue) . The order was based on Section 24 (2) of the Cattle Epidemics Act (Viehseuchengesetz) and Section 13 of the Rabies Ordinance (Tollwutverordnung) .

Insofar as the applicant was obliged to actively participate in the carrying out of the measures in question, he [also] invokes Article 4 para . 2 of the Convention according to which nobody shall be required to perform forced or compulsory labour . However, even if the above obligation would as such come within the notion of compulsory labour-which is doubtful-it would in any event be justified either under Article 4 para . 3 (c) which allows the exaction of services in case of an emergency or calamity threatening the life or well-being of the community, or under Article 4 para . 3 (d) which allows service which forms part of normal civic obligations . The Commission considers that the participation of a hunting tenant in measures of control of epidemics comes within the scope of these provisions . It follows that the applicant's complaint in this respect is manifestly ill-founded within the meaning of Article 27 para . 2 of the Convention .

I.e requérant a loué un terrain de chasse (Jagdpà chter) situé dans la zone couverte par un arrété de police (Viehseuchenpolizeiliche Anordnung) émis par l'administration locale (Bezirksregierung) de Coblence le 20 février 197 8 pour la lutte antirabique et obligeant à gazer tous les terriers de renards (Begasung aller Fuchsbaue) . L'artété se fondait sur l'article 24 par . 2 de la loi sur la peste bovine (Viehseuchengesetz) et sur l'article 13 de l'ordonnance sur la rage (Tollwutverordnung) .

EN DROIT (Extrait ) ............... Dans la mesure où le requérant a été obligé de participer activement à l'application des mesures en question, il invoque l'article 4 par . 2 de la Convention selon lequel nul ne peut être astreint à accomplir un travail forcé ou obligatoire . A supposer cependant que l'obligation susdite relève en tant que telle de la notion de travail obligatoire - ce qui est douteux - elle serait néanmoins justifiée au regard soit de l'article 4 par . 3 c), qui autorise de requérir des services dans le cas de crises ou de calamités qui menacent la vie ou le bien-être de la communauté, soit de l'article 4 par . 3 d), qui autorise de requérir également des services formant partie des obligations civiques normales . La Commission estime que la participation du locataire d'une chasse à des mesures de lutte contre les épizooties relève de ces dispositions . II s'ensuit que le grief formulé par le requérant à cet égard est manifestement mal fondé, au sens de l'article 27 par . 2 de la Convention .
